Dividing Fences Act 1961

Dividing Fences Regulations 1971

1.Citation

These regulations may be cited as the Dividing Fences Regulations 1971 1.

2.Interpretation

In these regulations — 

open spaces, public, rights of way, roads, streets, have the same respective meanings as they have in and for the purposes of the Town Planning and Development Act 1928; and

the Act means the Dividing Fences Act 1961.

3.Exclusion from meaning of “owner”

Under and for the purposes of the Act “owner” does not include — 

(a)any trustees or other persons in whom land is vested; or

(b)a person who has the care, control and management of land used,

for open spaces, streets, roads, or rights of way that are public.
