38. Requests, dealing with
(1) When a Form 1 is lodged in respect of a record in a case, a registrar may ¾
(a) grant the request if the request is made by a party to the case and is not made under the Act section 33(5);
(b) grant the request if ¾
(i) it is made under the Act section 33(5); and
(ii) the registrar is satisfied that the person making it is an interested party;
or
(c) otherwise, refer the request to a magistrate.
(2) A magistrate who is referred such a request may ¾
(a) without hearing the applicant, grant it; or
(b) after hearing the applicant, grant or refuse it.
