77. Exercise of certain powers when employee is appointed by Governor
In the case of an employee in a department or organization who is appointed by the Governor ¾
(a) the powers conferred on an employing authority by this Part (other than the power to terminate the employment in the Public Sector of the employee) may be exercised for and on behalf of the Governor ¾
(i) in the case of an employee who is a chief executive officer, by the Minister; or
(ii) in the case of an employee who is not a chief executive officer, by the employing authority of the department or organization; and
(b) the power to terminate the employment in the Public Sector of that employee (not being a chief executive officer) may be exercised by the Governor on the recommendation of the Minister of the Crown responsible for the department or organization.
