Planning and Development Regulations Amendment (Consequential Matters) Regulations 2024

Made by the Governor in Executive Council.

Part 1 — Preliminary

1.Citation

These regulations are the Planning and Development Regulations Amendment (Consequential Matters) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

(a)Part 1 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on 1 July 2024.

Part 2 — Planning and Development (Planning Codes) Regulations 2024 amended

3.Regulations amended

This Part amends the Planning and Development (Planning Codes) Regulations 2024.

4.Regulation 4 amended

In regulation 4 in the definition of public planning document paragraph (c) delete “14(b) or (c)” and insert:

 

14(c)(i), (ii), (iii) or (vi) or (d)

 

Part 3 — Planning and Development (Region Planning Schemes) Regulations 2023 amended

5.Regulations amended

This Part amends the Planning and Development (Region Planning Schemes) Regulations 2023.

6.Regulation 3 amended

In regulation 3 in the definition of public planning document:

(a)after paragraph (a) insert:

 

(aa)a planning code; or

 

(b)in paragraph (b) delete “14(b) or (c)” and insert:

 

14(c)(i), (ii), (iii) or (vi) or (d)

 

7.Regulation 4 amended

In regulation 4(1) delete “43(a)” and insert:

 

43(1)(a)

 

8.Regulation 5 amended

In regulation 5(1) delete “43(a)” and insert:

 

43(1)(a)

 

9.Regulation 6 amended

In regulation 6(1) delete “43(a)” and insert:

 

43(1)(a)

 

10.Regulation 7 amended

In regulation 7(3) delete “43(b)” and insert:

 

43(1)(b)

 

Part 4 — Planning and Development (State Planning Policies) Regulations 2024 amended

11.Regulations amended

This Part amends the Planning and Development (State Planning Policies) Regulations 2024.

12.Regulation 4 amended

In regulation 4 in the definition of public planning document paragraph (c) delete “14(b) or (c)” and insert:

 

14(c)(i), (ii), (iii) or (vi) or (d)
