Road Traffic (Authorisation to Drive) Amendment (Driving Restrictions) Act 2024

An Act to amend the Road Traffic (Authorisation to Drive) Act 2008.

[Assented to 15 November 2024]

The Parliament of Western Australia enacts as follows:

 

1.Short title

This is the Road Traffic (Authorisation to Drive) Amendment (Driving Restrictions) Act 2024.

2.Commencement

This Act comes into operation as follows —

(a)sections 1 and 2 — on the day on which this Act receives the Royal Assent;

(b)the rest of the Act — on the day after that day.

3.Act amended

This Act amends the Road Traffic (Authorisation to Drive) Act 2008.

4.Section 3 amended

(1)In section 3(1) insert in alphabetical order:

 

vary, the conditions or restrictions on a driver’s licence, includes impose a condition or restriction on a driver’s licence that was not subject to the condition or restriction before the variation.

 

(2)In section 3(1) in the definition of related Act paragraph (b) delete “regulations.” and insert:

 

regulations;

 

5.Section 4 amended

(1)In section 4(5)(b) delete “impose, or provide for the imposition of,” and insert:

 

impose or vary, or provide for the imposition or variation of,

 

(2)After section 4(5) insert:

 

(5A)The regulations may impose or vary restrictions on a driver’s licence, including —

(a)a licence authorising the holder to drive when learning; and

(b)a provisional licence.

 

6.Part 6 Division 2 inserted

At the end of Part 6 insert —

71.Application of amended regulation‑making provision for driver licensing scheme

(1)In this section —

commencement day means the day on which the Road Traffic (Authorisation to Drive) Amendment (Driving Restrictions) Act 2024 section 5 comes into operation.

(2)Section 4, as in force after commencement day, applies, and regulations made under that section may apply, in relation to drivers’ licences granted before, on or after commencement day.
