Fish Resources Management Act 1994

Fish Resources Management Amendment Regulations (No. 2) 2024

Made by the Governor in Executive Council.

1.Citation

These regulations are the Fish Resources Management Amendment Regulations (No. 2) 2024.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Fish Resources Management Regulations 1995.

4.Regulation 16DA amended

(1)Before regulation 16DA(1) insert:

 

(1A)In this regulation —

excluded boat means —

(a)a fishing boat; or

(b)a charter boat while it is being used to conduct a fishing tour.

 

(2)In regulation 16DA(1) delete “a fishing boat,” and insert:

 

an excluded boat,

 

5.Regulation 35 replaced

Delete regulation 35 and insert:

 

35.Possession of rock lobster tails

A person must not be in possession in WA waters of a rock lobster tail unless —

(a)the rock lobster tail is being consumed or prepared for immediate consumption; or

(b)the rock lobster tail —

(i)is on a charter boat while the boat is being used to conduct a fishing tour; and

(ii)is, or will be, prepared for consumption in the course of carrying on a business;

or

(c)the rock lobster tail is on a commercial passenger vessel that is not engaged in fishing.

Penalty:

(a)for an individual, a fine of $5 000 and the penalty provided in section 222 of the Act;

(b)for a body corporate, a fine of $10 000 and the penalty provided in section 222 of the Act.

35A.Sale of rock lobster parts

A person must not sell a part only of a rock lobster unless —

(a)the person is authorised to do so under a fish processor’s licence and the part is a part of a whole rock lobster which was processed at the place specified in the licence as the place at which fish are to be processed; or

(b)the part was purchased from the place specified in a fish processor’s licence as the place at which rock lobster is to be processed and the person has a receipt detailing that purchase; or

(c)the rock lobster was kept, bred, hatched or cultured in accordance with an aquaculture licence.

Penalty:

(a)for an individual, a fine of $5 000 and the penalty provided in section 222 of the Act;

(b)for a body corporate, a fine of $10 000 and the penalty provided in section 222 of the Act.

 

6.Regulation 38D amended

Delete regulation 38D(3) and insert:

 

(3)A person must not fish for sea urchins for a commercial purpose in Abalone Zone 1, 2 or 3 unless the person is authorised to take sea urchins under a commercial fishing licence.

Penalty for this subregulation: a fine of $5 000 and the penalty provided in section 222 of the Act.

 

7.Regulation 44 deleted

Delete regulation 44.

8.Regulation 55A amended

In regulation 55A delete the definition of automatic location communicator or ALC and insert:

 

automatic location communicator or ALC means —

(a)an electronic device for receiving, recording, generating, responding to and transmitting information, including information about the geographical position of a boat; and

(b)includes hardware, software or firmware that is capable of facilitating the operation of that device;

 

9.Regulation 55C amended

(1)In regulation 55C(1) insert in alphabetical order:

 

operating effectively, in relation to an ALC, means that the ALC is accurately receiving, recording, generating, responding to and transmitting information.

 

(2)In regulation 55C(1) in the definition of ALC fishing boat delete “directions.” and insert:

 

directions;

 

10.Regulation 55E amended

In regulation 55E insert in alphabetical order:

 

NDS Managed Fishery means the Northern Demersal Scalefish Managed Fishery;

PT Managed Fishery means the Pilbara Trap Managed Fishery;

 

11.Regulation 55F amended

(1)In regulation 55F(1) delete “(3) and (4),” and insert:

 

(3), (4) and (5),

 

(2)After regulation 55F(4) insert:

 

(5)Subregulation (1) does not apply in relation to a boat that is authorised to be used for or in connection with fishing in the NDS Managed Fishery or the PT Managed Fishery.

 

12.Regulation 55FA inserted

At the end of Part 4 Division 7B insert:

 

55FA.Bait bands to be broken

(1)In this regulation —

broken, in relation to a bait band, means that the band is cut through or pulled open so that it no longer forms a continuous loop;

specified boat means a boat referred to in regulation 55F(5).

(2)The master of a specified boat must ensure that a bait band securing a carton is broken when the carton is opened.

Penalty for this subregulation: a fine of $2 000.

 

13.Regulation 64 amended

(1)In regulation 64(4) delete “subregulation (6),” and insert:

 

subregulations (4A) and (6),

 

(2)After regulation 64(4) insert:

 

(4A)If the person who is to keep records under this regulation holds an aquaculture licence —

(a)subregulation (4) does not apply; and

(b)the person must submit a return to the Department regarding the activity each financial year —

(i)in the form, if any, approved for that activity by the CEO; and

(ii)by sending the return to the Department to arrive not later than 15 July in the following financial year.

 

(3)In regulation 64(6) after “subregulation (4)” insert:

 

or a return under subregulation (4A)

 

14.Regulation 64S amended

(1)Delete regulation 64S(1)(b) and insert:

 

(b)1 or more rods, reels and lines, or hand‑held lines; and

 

(2)Delete regulation 64S(3)(b) and insert:

 

(b)1 or more rods, reels and lines, or hand‑held lines; and

 

15.Regulation 64T amended

In regulation 64T delete the passage that begins with “net —” and ends with “hand‑held line.” and insert:

 

net is used only for the purpose of landing teleost fish taken by means of a rod, reel and line or a hand‑held line.

 

16.Regulation 69 amended

In regulation 69:

(a)in paragraph (c) delete “in triplicate”;

(b)delete paragraph (c)(ii) and (iii) and insert:

 

(ii)retain a copy of the consignment note at the place where aquaculture is carried out under the licence;

 

17.Regulation 144M amended

At the end of regulation 144M insert:

 

Penalty: a fine of $10 000.

 

18.Regulation 156 amended

In regulation 156 in the Table after “35,” insert:
