Made by the Governor in Executive Council.
These regulations come into operation as follows —
(a)Part 1 — on the day on which these regulations are published on the WA legislation website;
(b)the rest of the regulations — on the day after that day.
Part 2 — Betting Control Regulations 1978 amended
This Part amends the Betting Control Regulations 1978.
Delete regulation 102 and insert:
102.Prescribed period: section 14A(2)(a)
For the purposes of section 14A(2)(a) of the Act, the period is 14 days beginning on the first day of each month.
In regulation 103 delete “operator on or after 1 September 2008.” and insert:
operator.
In regulation 106 delete “operator on or after 1 September 2008.” and insert:
operator.
After regulation 110 insert:
111.Prescribed offences and modified penalties
(1)The offences specified in Schedule 2 are offences for which an infringement notice may be issued under the Criminal Procedure Act 2004 Part 2 as modified by the Gaming and Wagering Commission Act 1987 section 36.
(2)For the purposes of the Criminal Procedure Act 2004 section 5(3), the penalty specified opposite an offence in Schedule 2 is the modified penalty for that offence.
(3)However, the modified penalty specified for each offence specified in Schedule 2 Division 2 items 19 to 50 is not applicable in a case where regulation 77D(2) is relied on in relation to a person described in paragraph (b) of the definition of responsible person in regulation 77D(1).
112.Forms for infringement notice and withdrawal notice
(1)For the purposes of the Criminal Procedure Act 2004 section 6(d), the form of an infringement notice is Schedule 1 Form 2.
(2)For the purposes of the Criminal Procedure Act 2004 section 15(2), the form stating that an infringement notice has been withdrawn is Schedule 1 Form 3.
(1)Delete the reference after the heading to Schedule 1 and insert:

Part 4 — Casino Control Regulations 1999 amended
This Part amends the Casino Control Regulations 1999.
(1)In regulation 2(1) insert in alphabetical order:
manuals means manuals about the management and operation of a casino mentioned in section 24A(1) of the Act.
(2)In regulation 2(1) in the definition of conviction delete “(2).” and insert:

At the end of Part 2 insert:
5.Prescribed matters for manuals
For the purposes of section 24A(1) of the Act, manuals must deal with the following matters —
(a)gaming operations;
(b)internal management and control;
(c)handling, dealing with and accounting for money, chips, vouchers, cheques, digital currencies and similar things;
(d)internal management and control;
(e)surveillance and security;
(f)the responsible service of gambling.
6.Casino licensee must provide manual and amended manual to Commission
(1)A casino licensee must provide a manual to the Commission, within a period specified in writing by the Commission, for the purposes of the Commission considering the manual for approval under section 24A(1) of the Act.
Penalty for this subregulation: a fine of $25 000.
(2)If the Commission requires under section 24A(2) that an approved manual of a casino licensee be amended, the licensee must provide the amendment to the Commission, within a period specified in writing by the Commission, for the purposes of the Commission considering the amendment for approval under section 24A(1) of the Act.
Penalty for this subregulation: a fine of $25 000.
7.Prescribed period for suspicious matter reports
(1)In this regulation —
business day means a day other than a Saturday, Sunday or public holiday.
(2)For the purposes of section 30A of the Act, the period —
(a)begins at the time the casino licensee’s suspicious matter reporting obligation arises under the Anti‑Money Laundering and Counter‑Terrorism Financing Act 2006 (Commonwealth) section 41(1); and
(b)ends 1 business day after the following, as is relevant —
(i)the day by which the casino licensee is required to give the report under the Anti‑Money Laundering and Counter‑Terrorism Financing Act 2006 (Commonwealth) section 41(2)(a);
(ii)the time by which the casino licensee is required to give the report under the Anti‑Money Laundering and Counter‑Terrorism Financing Act 2006 (Commonwealth) section 41(2)(b).
Delete Part 4 and insert:

Part 5 — Gaming and Wagering Commission Regulations 1988 amended
This Part amends the Gaming and Wagering Commission Regulations 1988.
Delete regulation 3(2) and (3).
Delete regulation 6 and insert:
5A.Prescribed offences and modified penalties
(1)The offences specified in Schedule 2 are offences for which an infringement notice may be issued under the Criminal Procedure Act 2004 Part 2 as modified by section 36.
(2)For the purposes of the Criminal Procedure Act 2004 section 5(3), the penalty specified opposite an offence in Schedule 2 is the modified penalty for that offence.
(3)However, the modified penalty specified for each offence specified in Schedule 2 Division 2 items 4 to 35 is not applicable in a case where regulation 40E(2) is relied on in relation to a person described in paragraph (b) of the definition of responsible person in regulation 40E(1).
6.Forms for infringement notice and withdrawal notice
(1)For the purposes of the Criminal Procedure Act 2004 section 6(d), the form of an infringement notice is Schedule 3 Form 1.
(2)For the purposes of the Criminal Procedure Act 2004 section 15(2), the form stating that an infringement notice has been withdrawn is Schedule 3 Form 2.
(1)In regulation 43(2), (6) and (7) delete the Penalty.
(2)After regulation 43(8) insert:
(9)A person who contravenes subsection (2) or (7) commits an offence.
(10)A gambling operator who contravenes subsection (6) commits an offence.

TAKE NOTICE |
It is alleged that you have committed the above offence. If you do not want to be prosecuted in court for the offence, pay the modified penalty to the Approved Officer (the Gaming and Wagering Commission) within 28 days after the date of this notice. If you do not pay the modified penalty within 28 days after the date of this notice, you may be prosecuted or enforcement action may be taken under the Fines, Penalties and Infringement Notices Enforcement Act 1994.
