Planning and Development (Fees) Amendment Notice 2025

Made by the Minister under section 20(1) of the Act.

1.Citation

This notice is the Planning and Development (Fees) Amendment Notice 2025.

2.Commencement

This notice comes into operation as follows —

(a)clauses 1 and 2 — on the day on which this notice is published on the WA legislation website;

(b)the rest of the notice — on 1 July 2025.

3.Notice amended

This notice amends the Planning and Development (Fees) Notice 2021.

4.Schedule 1 replaced

Delete Schedule 1 and insert:

An application for approval of freehold, survey‑strata (freehold or leasehold) or community titles scheme subdivision —

 

 

(a)if the application is for approval of amalgamation only —

 

 

(i)if the application is contemporaneous with another application for approval of subdivision and a fee is paid in relation to that other application

No fee

 

(ii)if subparagraph (i) does not apply to the application

$2 700

 

(b)if the application is for approval of amalgamation and other subdivision or for approval of subdivision without amalgamation —

 

 

(i)if the subdivision is into 100 or fewer lots


$3 743 plus $83 per lot

 

(ii)if the subdivision is into 101 or more lots


$12 043 plus $28 per lot in excess of 100 lots

Examples for this item:

1.For an application for approval of subdivision into 5 lots to which item 1(b) applies, the fee is $3 743 plus $415 (5 lots multiplied by $83), which totals $4 158.

2.For an application for approval of subdivision into 105 lots to which item 1(b) applies, the fee is $12 043 plus $140 (5 lots multiplied by $28), which totals $12 183.

A lodgment of an amended plan for an application for approval of freehold, survey strata (freehold or leasehold) or community titles scheme subdivision —

 

 

(a)if the lodgment relates to an application for approval of amalgamation only —

 

 

(i)if the lodgment relates to an application for which no fee was paid under item 1(a)(i)

No fee

 

(ii)if subparagraph (i) does not apply to the lodgment

(b)if the lodgment relates to an application for approval of amalgamation and other subdivision or for approval of subdivision without amalgamation —

 

 

(i)if the subdivision is into 100 or fewer lots


$1 364 plus $27 per lot

 

(ii)if the subdivision is into 101 or more lots

 


$4 064 plus $4 per lot in excess of 100 lots

Notes for this item:

1.Where a minor variation is made at the request of the WAPC, the WAPC may waive some or all of the applicable fee.

2.Form 2A is the form for this application, and can be found on the Department’s website.

Examples for this item:

1.For a lodgment that relates to an application for approval of subdivision into 5 lots to which item 2(b) applies, the fee is $1 364 plus $135 (5 lots multiplied by $27), which totals $1 499.

2.For a lodgment that relates to an application for approval of subdivision into 105 lots to which item 2(b) applies, the fee is $4 064 plus $20 (5 lots multiplied by $4), which totals $4 084.

A request under section 144(1) of the Act to reconsider a refusal to approve a plan of subdivision, or under section 151(1) of the Act to reconsider a condition imposed on a plan of subdivision —

 

 

(a)if the request relates to a plan of amalgamation only

1.For a request that relates to a plan for subdivision into 5 lots to which item 3(b) applies, the fee is $1 540 plus $165 (5 lots multiplied by $33), which totals $1 705.

2.For a request that relates to a plan for subdivision into 105 lots to which item 3(b) applies, the fee is $4 840 plus $30 (5 lots multiplied by $6), which totals $4 870.

An application for endorsement of a deposited plan, survey‑strata (freehold or leasehold) plan or community titles scheme plan —

 

 

(a)if the application is for endorsement of a plan of amalgamation only —

 

 

(i)if the application for endorsement relates to an application for which no fee was paid under item 1(a)(i)

No fee

 

(ii)if subparagraph (i) does not apply to the application

(b)if the application is for endorsement of a plan of subdivision that includes an amalgamation or a plan of subdivision without an amalgamation —

 

 

(i)if the subdivision is into 100 or fewer lots


$701 plus $8 per lot

 

(ii)if the subdivision is into 101 or more lots


$1 501 plus $5 per lot in excess of 100 lots

1.For an application for endorsement of a plan to subdivide into 5 lots to which item 4(b) applies, the fee is $701 plus $40 (5 lots multiplied by $8), which totals $741.

2.For an application for endorsement of a plan to subdivide into 105 lots to which item 4(b) applies, the fee is $1 501 plus $25 (5 lots multiplied by $5), which totals $1 526.

An application for approval by the WAPC of a lease or licence under section 136 of the Act
