Mental Health Act 2014

Mental Health Amendment Regulations (No. 5) 2025

Made by the Governor in Executive Council.

1.Citation

These regulations are the Mental Health Amendment Regulations (No. 5) 2025.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Mental Health Regulations 2015.

4.Regulation 7 replaced

Delete regulation 7 and insert:

 

7.Transport officers (Act s. 147)

For section 147 of the Act, a person is authorised to carry out a transport order if —

(a)the person is —

(i)an employee of a person engaged under a contract for services to provide transport services for the purposes of the Act; or

(ii)a staff member of a health service provider (as those terms are defined in the Health Services Act 2016 section 6);

and

(b)the person’s duties of employment include the carrying out of the order.
