Rules of Wagering Amendment Rules 2025
Made by Racing and Wagering Western Australia with the approval of the Commission under section 120 of the Act.
These rules come into operation as follows —
(a)rules 1 and 2 — on the day on which these rules are published on the WA legislation website;
(b)the rest of the rules — on the day after that day.
These rules amend the Rules of Wagering 2005.
In rule 3(1) insert in alphabetical order:
cash out amount means an amount offered under rule 62AA(2) or 62Y(2);
In rule 50(5) delete “subregulation (4),” and insert:

At the end of Part 5 insert:
62AA.Cash out on wagers made with bookmakers
(1)This rule applies in relation to a wager referred to in rule 50(1).
(2)A bookmaker may, on request and at any time before the completion of a race or series of races (whichever is applicable) in relation to which a wager is placed, offer an amount in settlement of the wager.
(3)If an investor accepts a cash out amount offered under subrule (2) in respect of a wager before the completion of the race or series of races in relation to which the wager is placed, the wager is settled at that amount.
(1)In rule 62U(1) insert in alphabetical order:
correct cash out amount, in relation to a mistaken cash out amount, means the amount RWWA would have offered to an investor but for the error;
mistaken cash out amount means a cash out amount offered in error to an investor in settlement of a wager.
(2)In rule 62U(1) in the definition of error after paragraph (b)(iii) insert:
(iv)an error by RWWA as to a cash out amount offered to an investor;
(3)In rule 62U(1) in the definition of mistaken acceptance paragraph (b) delete “wager.” and insert:
wager;
(4)In rule 62U(2) after “wager” (1st occurrence) insert:
other than an error described in subrule (3)
(5)After rule 62U(2) insert:
(3)If an error occurs in relation to a cash out amount offered to an investor, RWWA may notify the investor that the mistaken cash out amount was offered in error and offer the correct cash out amount in settlement of the wager.
(4)If RWWA offers a correct cash out amount as described in subrule (3), an investor may accept the correct cash out amount in settlement of the wager only within 24 hours after the offer is made.
(5)If an investor accepts a correct cash out amount as described in subrule (4), the wager is settled at that amount.
(6)If an investor does not accept an offer as described in subrule (4), the wager is settled in accordance with rule 62M.
(7)Notification of an error and the offer of a correct cash amount under subrule (3) voids the settlement of the wager under rule 62Y(3).
At the end of Part 5A insert:
62Y.Cash out on wagers made with RWWA
(1)This rule applies in relation to a wager referred to in rule 62D(1).
(2)RWWA may, on request and at any time before the completion of a race or series of races (whichever is applicable) in relation to which a wager is placed, offer an amount in settlement of the wager.
(3)Subject to rule 62U(7), if an investor accepts a cash out amount offered under subrule (2) in respect of a wager before the completion of the race or series of races in relation to which the wager is placed, the wager is settled at that amount.
