Planning and Lands Regulations Amendment Regulations 2025

Made by the Governor in Executive Council.

Part 1 — Preliminary

1.Citation

These regulations are the Planning and Lands Regulations Amendment Regulations 2025.

2.Commencement

These regulations come into operation as follows —

(a)Part 1 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on the day after that day.

Part 2 — Registration of Deeds Regulations 2004 amended

3.Regulations amended

This Part amends the Registration of Deeds Regulations 2004.

4.Regulation 3 amended

(1)In regulation 3 insert in alphabetical order:

 

TLA application means an application to bring land under the Transfer of Land Act 1893 within the meaning of that Act.

 

(2)In regulation 3 in the definition of Registrar delete “Transfers.” and insert:

 

Transfers;

 

5.Regulation 5A inserted

After regulation 5 insert:

 

5A.Waiving and refunding fees in relation to copies for TLA applications

The Registrar may waive or refund the fee set out in Schedule 1 Division 2 item 1 in relation to a copy of a document referred to in that item if —

(a)the copy is supplied for the purposes of making a TLA application; and

(b)the Registrar is satisfied it is appropriate to waive or refund the fee.

 

6.Schedule 1 amended

(1)Delete Schedule 1 Division 1 item 1 and insert:

For registering, recording, enrolling or receiving on deposit, any memorial, enrolment or instrument —

 

 

(a)if the memorial, enrolment or instrument relates to the making of a TLA application


No fee

 

(b)otherwise

$188.60

 

(2)At the end of Schedule 1 Division 2 item 1 insert:

 

Note for this item:

This fee may be waived or refunded by the Registrar under regulation 5A.

 

(3)Delete Schedule 1 Division 3 item 1 and insert:

For a certification by the Registrar —

 

 

(a)if the certification relates to the making of a TLA application


No fee

 

(b)otherwise

$77.00

 

Part 3 — Transfer of Land Regulations 2004 amended

7.Regulations amended

This Part amends the Transfer of Land Regulations 2004.

8.Regulation 9A amended

After regulation 9A(9)(b) insert:

 

(c)Schedule 1 Division 6 if the matter relates to an application to bring land under the Act; or

 

9.Schedule 2 amended

In Schedule 2 after item 10 insert:

 

11.An application to bring land under the Act.

12.Lodgment of a plan that relates to an application to bring land under the Act.

13.Withdrawal of a document that relates to an application to bring land under the Act from registration or recording.
