An Act to amend the Cross‑border Justice Act 2008.
[Assented to 9 March 2010]
The Parliament of Western Australia enacts as follows:
1. Short title
This is the Cross-border Justice Amendment Act 2010.
2. Commencement
This Act comes into operation as follows —
(a) sections 1 and 2 — on the day on which this Act receives the Royal Assent (assent day);
(b) the rest of the Act —
(i) when the Cross‑border Justice Act 2008 section 4 comes into operation; or
(ii) if assent day is later than the day on which the Cross‑border Justice Act 2008 section 4 comes into operation — on assent day.
3. Act amended
This Act amends the Cross‑border Justice Act 2008.
4. Section 7 amended
In section 7(1) in the definition of office holder delete “participating” (first occurrence) and insert:

In section 29 delete “(1) This Division” and insert:

7. Section 36 amended
In section 36(1) delete “released.” and insert:

8. Section 54 amended
(1) In section 54(1)(a) —
(a) after “jurisdiction” (first occurrence) insert:
(the arresting jurisdiction)
(b) delete “that other jurisdiction (the arresting jurisdiction) —” and insert:
the arresting jurisdiction —
(2) In section 54(2)(b) delete “that other jurisdiction” and insert:
the arresting jurisdiction
9. Section 55 amended
In section 55(1):
(a) in paragraph (a) delete “jurisdiction —” and insert:
jurisdiction (the investigating jurisdiction) —
(b) in paragraph (a)(i) delete “that other jurisdiction (the investigating jurisdiction); or” and insert:
the investigating jurisdiction; or

This Act does not affect the operation of the Coroners Act 1996 in relation to the investigation of the death of a person.
