Road Traffic (Drivers’ Licences) Regulations 1975

1.Citation

These regulations may be cited as the Road Traffic (Drivers’ Licences) Regulations 1975 1.

2.Interpretation

In these regulations, unless the contrary intention appears — 

age pension means an age pension from the Department of Social Security, or the Department of Veterans’ Affairs, of the Commonwealth;

pension means a pension from the Department of Social Security, or the Department of Veterans’ Affairs, of the Commonwealth;

pensioner concession card means a pensioner concession card issued by the Department of Social Security, or the Department of Veterans’ Affairs, of the Commonwealth;

seniors’ card means a seniors’ card issued by the Office of Seniors’ Interests in this State.

3.Classification of vehicles

For the purposes of Part V of the Act, motor vehicles are classified as follows — 

A.(i)Any motor car equipped to seat 12 or less adult persons (including the driver);

(ii)any motor wagon having an aggregate of 4 500 kg or less; and

(iii)any tractor (not prime mover type) having a tare of 4 572 kg or less.

B.(i)Any motor car equipped to carry more than 12 adult persons (including the driver) except when the motor car is being used to carry passengers for hire or reward;

(ii)any motor wagon (not being articulated type); and

(iii)any tractor.

C.Any articulated vehicle.

E.Any motor car fitted with automatic transmission.

F.Any vehicle licensed or used as an omnibus.

H.Any motor car equipped to carry more than 12 adult persons (including the driver) not being an omnibus.

I.Any tractor (not prime mover type) having a tare of 4 572 kg or less.

J.Any tractor (not prime mover type).

K.(i)Any motor cycle with or without side car attachment; and

(ii)any motor carrier,

with engine capacity exceeding 250 c.c.

L.Any — 

(i)motor cycle with or without side car attachment; or

(ii)motor carrier,

with engine capacity not exceeding 250 c.c.

M.Any — 

(i)moped; and

(ii)motor cycle with an engine capacity not exceeding 100 c.c. that is not fitted with a hand or foot operated clutch.

N.Any moped only.

T.Any vehicle being operated as a taxi under the Taxi Act 1994 or the Transport Co‑ordination Act 1966 2.

4.Driver to demonstrate ability

(1)In order to satisfy the Director General that he is qualified to obtain the driver’s licence sought, the applicant shall demonstrate his ability to control — 

(a)in the case of a licence appropriate to Class A, a motor car, or a motor wagon, fitted with manual gears;

(b)in the case of a licence appropriate to Class B, a motor wagon or tractor (prime mover type) having an aggregate exceeding 4 500 kg or an omnibus having a tare exceeding 2 032 kg;

(c)in the case of a licence appropriate to Class K, either vehicle of that class;

(d)in the case of a licence appropriate to Class L, either vehicle of that class; and

(e)in the case of a licence appropriate to Class M, either vehicle of that class.

(2)A person, being the holder of a licence appropriate to a class set out in Column 1, hereunder, is entitled to drive, on a road, any vehicle of a class set out in the correspondingly opposite position in Column 2, hereunder, subject, however, to any conditions in the latter column mentioned.

(3)An applicant for a licence to drive a Class K vehicle, shall have been the holder of a driver’s licence for a Class L vehicle for a period of not less than 12 months, but where the applicant was immediately before the application — 

(a)regarded as the holder of a driver’s licence applicable to a Class K vehicle pursuant to section 48D of the Act; or

(b)authorized to drive a Class K vehicle pursuant to section 48E of the Act,

he shall be issued with a licence to drive a Class K vehicle.

(4)The holder of a driver’s licence appropriate to Class F or Class T shall, subject to section 42(6), submit himself to a medical examination — 

(a)at intervals of 5 years until attaining the age of 45 years;

(b)at intervals of 2 years after attaining the age of 45 years until he attains the age of 65 years;

(c)annually after attaining the age of 65 years.

(5)The holder of a driver’s licence appropriate to Class T is only entitled to drive a vehicle which is being operated as a taxi if he is also the holder of a driver’s licence appropriate to the class, other than Class T, to which that vehicle belongs.

(6)An applicant for a licence to drive a Class T vehicle shall be the holder of a driver’s licence — 

(a)that is appropriate to the class, other than Class T, to which the vehicle being, or to be, operated as a taxi belongs; and

(b)that is not issued on probation.

5.Minimum age of licensee

Subject to the exercise of the powers conferred on the Director General, by section 42 of the Act, a licence appropriate to a class set out in Column 1, hereunder, shall not be issued to a person, unless he has attained the age set out in the correspondingly opposite position in Column 2, hereunder.

5A.Period of licence

(1)For the purposes of section 46(1) of the Act a driver’s licence may be issued or renewed to have effect for — 

(a)a period of 12 months or 5 years; or

(b)a period, not exceeding 5 years, determined by the Director General under subregulation (2) or (3).

(2)A driver’s licence to which section 42(4) of the Act applies shall be issued or renewed to have effect for a period determined by the Director General having regard to the intervals at which the holder of the licence is required to submit himself to a medical examination under section 42(5) of the Act.

(3)A driver’s licence which is subject to any condition or limitation under section 44 or section 48(5) or (6) of the Act shall be issued or renewed to have effect for a period determined by the Director General, being a period that the Director General considers appropriate having regard to the grounds on which any such condition or limitation was imposed.

6.Endorsement on probationary licence

Every licence issued on probation shall be endorsed, in the space set apart for conditions, with the words, “ON PROBATION until”, followed by the date on which, but for the provisions of section 51 of the Act, the period of probation would ordinarily expire.

8.Forms

The forms to be used for the purposes of these regulations are such as may be approved by the Director General.

9.Duplicate licence

Where a person satisfies the Director General that a driver’s licence issued to him has been lost or destroyed, he may obtain a duplicate thereof, on payment of an amount of $9.80.

9A.Replacement of licence by licence in new form

Where the Director General has approved a new form of licence under section 42A of the Act, it may on — 

(a)application being made in a form approved by the Director General by the holder of a driver’s licence;

(b)the surrender of that licence; and

(c)payment of a fee of $7.00,

issue to the applicant a driver’s licence in the new form to the same effect as the surrendered licence.

10.Offences prescribed for s.103

(1)The several offences set out in the Second Schedule are those prescribed for the purposes of section 103 of the Act and the numeral appearing in the final column of that Schedule, directly opposite an offence, is, subject to subregulation (2) the prescribed number of points to be recorded against a person convicted of that offence.

(2)Where a court, in exercise of the powers conferred by section 74 of the Act, suspends the driver’s licence of a person convicted of any offence in connection with the driving of a motor vehicle, points shall not be recorded against that person under the provisions of this regulation, in respect of that offence.

11.Points for various offences

For the purposes of section 103(1) of the Act, the prescribed aggregate of points recorded against a person that will occasion his driver’s licence to be suspended and occasion him to be disqualified from holding or obtaining a driver’s licence, by operation of that section, is 12.

12.Period of suspension, etc.

For the purposes of section 103(1) of the Act, the period for which a person’s driver’s licence is suspended and for which he is disqualified from holding or obtaining such a licence, upon the points recorded against him amounting to 12, is 3 months.

13.“P” plates

(1)Subject to subregulation (2), a person shall not drive a motor vehicle in respect of which he is the holder of a driver’s licence issued on probation unless — 

(a)a plate that bears the letter “P”, in red on a white ground, where the plate and the “P” are of at least the same size as shown in the diagram below, is displayed on the front of the vehicle so as to be readily visible from the front; and

(b)another plate identical to that described in paragraph (a) is displayed on the rear of the vehicle so as to be readily visible from the rear.

Penalty: Two penalty units (2 PU).

(2)Subregulation (1) does not apply to a person — 

(a)who, being the holder of a driver’s licence under the Act, has been authorized, under the law in force in another State or in a Territory of the Commonwealth or in some other country, for a period of, or for periods, amounting in the aggregate to, one year or more, to drive a motor vehicle; or

(b)whose only authority to drive a motor vehicle in the State is that conferred by section 48D or 48E of the Act,

but where, on the hearing of a complaint of an offence against subregulation (1), the defendant sets up that he is a person mentioned in this subregulation, the proof of that fact lies upon him.

(3)A person who, not being a person required by this regulation to do so, displays on a motor vehicle driven by him a plate such as is mentioned in subregulation (1) commits an offence.

Penalty: One penalty unit (1 PU).

(4)The Director General shall issue plates such as are mentioned in subregulation (1) free of charge.

14.Drivers, 75 years or more

(1)The prescribed intervals for the purpose of section 48(7) of the Act are — 

(a)before the first renewal of a driver’s licence after a licence holder has reached 75 years of age;

(b)before the first renewal of a driver’s licence after a licence holder has reached 78 years of age; and

(c)before each renewal of a driver’s licence, after a licence holder has reached 80 years of age.

(2)Where a person has, within a period of 3 years immediately prior to the first renewal of his licence after reaching the age of 75 years, complied with the requirements of section 42(2)(c) of the Act, or of section 23(2)(c) of the Traffic Act 1919 3, then the provisions of subregulation (1)(a) shall not apply.

14A.Fees

The following fees are payable in respect of the matters set out below —

14B.Driving tests

(1)In this regulation —

allocated time” means the date and time appointed by the Director General for a particular applicant to attend for a driving test.

(2)The payment of the fees prescribed in items 1(a) or 2 of regulation 14A entitles an applicant to a driving test at the allocated time.

(3)The Director General may change the allocated time either at the request of, or with the consent of, an applicant.

(4)Any request by an applicant to change the allocated time must be made more than 48 hours before the allocated time.

(5)Subject to subregulation (6), if an applicant fails to attend at the allocated time, the applicant’s entitlement to a driving test is forfeited and the fee prescribed by item 2 of regulation 14A must be paid before he or she is entitled to a driving test.

(6)The Director General may permit an applicant to attend a driving test at a reallocated time if satisfied that there were extenuating circumstances which prevented the applicant from attending at the allocated time or having that time changed in accordance with subregulations (3) and (4).

15.Fees for extraordinary licences

(1)For the purposes of section 76(3) the prescribed fee for the issue of an extraordinary licence is — 

(a)where the licence is issued for a period not exceeding 6 months — $68.50,

(b)where the licence is issued for a period exceeding 6 months — $137.00.

(2)For the purposes of section 76(6) the prescribed fee for the renewal of an extraordinary licence is — 

(a)where the licence is renewed for a period not exceeding 6 months — $15.00,

(b)where the licence is renewed for a period exceeding 6 months — $30.00.

15A.Fee exemption for age pensioners

(1)This regulation applies to a person if the Director General is satisfied that the person is receiving an age pension.

(2)No fee is payable for the issue or renewal of a driver’s licence where the applicant is a person to whom this regulation applies.

(3)No fee is payable under regulation 9 or 9A where the applicant is a person to whom this regulation applies.

15B.Reduction in fees for other pensioners and holders of seniors’ cards

(1)This regulation applies to a person if regulation 15A does not apply to that person and the Director General is satisfied that the person — 

(a)holds a pensioner concession card and is receiving a pension other than an age pension; or

(b)holds a seniors’ card.

(2)The fee set out in regulation 9 is to be reduced by 50% where the applicant is a person to whom this regulation applies.

(3)The fee set out in regulation 9A is to be reduced by 50% where the applicant is a person to whom this regulation applies.

(4)The fee set out in item 3 of regulation 14A is to be reduced to one tenth of the fee set out in item 4 of regulation 14A where the applicant is a person to whom this regulation applies.

(5)The fee set out in item 4 of regulation 14A is to be reduced by 50% where the applicant is a person to whom this regulation applies.

(6)In calculating the fee payable under item 5 of regulation 14A the reference to “the fee under item 4is to be read as a reference to the fee under item 4 as reduced under subregulation (5) where the applicant is a person to whom this regulation applies.

15C.Fee exemption for motorized wheelchairs

No fee is payable for the issue or renewal of a driver’s licence if the Director General is satisfied that the driver’s licence is granted in respect of, and limited to, the driving of a motorized wheelchair.

15D.Refund of fees in particular cases

(1)The Director General may, in a particular case, refund all or part of any fee paid for the issue or renewal of a driver’s licence if, in the Director General’s opinion, it is just and convenient to give such a refund.

(2)The Director General must not give a refund under this regulation in respect of any period that is less than 1 year.

(3)The Director General may charge a fee of $1 for giving any refund under this regulation and the fee may be deducted from the amount refunded.

15E.Statutory declarations

The Director General may, in order to be satisfied that a person is entitled to an exemption, refund or reduction under these regulations, require any information contained in an application to be verified by statutory declaration.

16.Change of address

(1)The holder of a driver’s licence shall, within 21 days after every change of his address as stated in the licence, give notice in writing of the change to the Director General.

(2)A person who commits a breach of subregulation (1) is liable, for a first offence, to a penalty not exceeding four penalty units (4 PU) and, for a subsequent offence, to a penalty not exceeding eight penalty units (8 PU).
