Agricultural Practices (Disputes) Repeal Act 2011

An Act to repeal the Agricultural Practices (Disputes) Act 1995 and for related purposes.

The Parliament of Western Australia enacts as follows:

 

Part 1  Preliminary

1.           Short title

             This is the Agricultural Practices (Disputes) Repeal Act 2011.

                  Note:  Under the Interpretation Act 1984 section 20(2), this Act comes into operation on the 28th day after the day on which it receives the Royal Assent.

Part 2  Agricultural Practices (Disputes) Act 1995 repealed

2.           Agricultural Practices (Disputes) Act 1995 repealed

             The Agricultural Practices (Disputes) Act 1995 is repealed.

Part 3  Other Acts amended

3.           Constitution Acts Amendment Act 1899 amended

     (1)    This section amends the Constitution Acts Amendment Act 1899.

     (2)    In Schedule V Part 3 delete the item for the Agricultural Practices Board of Western Australia.

4.           Environmental Protection Act 1986 amended

     (1)    This section amends the Environmental Protection Act 1986.

     (2)    Delete section 74B(2)(c) and (d) and insert:

 

    (c)    an act of a kind that the chief executive officer of the department of the Public Service principally assisting in the administration of the Biosecurity and Agriculture Management Act 2007 has specified, by order published in the Gazette, to be a normal agricultural activity for the purposes of this paragraph; or

    (d)    an agricultural activity (including the management or harvesting of a plantation) done in compliance with a code of practice relating to an activity of that kind —

     (i)    issued under section 122A; or

     (ii)    made or approved under any other written law;

             or

 

5.           Financial Management Act 2006 amended

     (1)    This section amends the Financial Management Act 2006.

     (2)    In Schedule 1 delete the item for the Agricultural Practices Board of Western Australia.
