An Act to amend the Child Support (Adoption of Laws) Act 1990.
[Assented to 22 November 2012]
The Parliament of Western Australia enacts as follows:
1. Short title
This is the Child Support (Adoption of Laws) Amendment Act 2012.
2. Commencement
(1) Sections 1, 2, 3, 4, 5 and 6(1) come into operation on the day on which this Act receives the Royal Assent.
(2) Unless it is deleted by section 3(1), section 6(2) comes into operation on 1 January 2013.
(3) Unless it is deleted by section 3(2), section 6(3) comes into operation on 1 July 2013.
3. Conditional deletions
(1) If, after 1 July 2012 but on or before 1 January 2013, an amendment is made to the Child Support (Assessment) Act 1989 (Commonwealth) other than by the Social Security and Other Legislation Amendment (Disability Support Pension Participation Reforms) Act 2012 (Commonwealth), section 6(2) is deleted.
(2) If, after 1 July 2012 but on or before 1 July 2013, an amendment is made to the Child Support (Assessment) Act 1989 (Commonwealth) other than by the Social Security and Other Legislation Amendment (Disability Support Pension Participation Reforms) Act 2012 (Commonwealth), section 6(3) is deleted.
4. Act amended
This Act amends the Child Support (Adoption of Laws) Act 1990.
5. Section 3 amended
In section 3(a) delete “1 October 2010; and” and insert:
1 July 2012; and
Note: The purpose of this amendment is to ensure that the adoption by
(a) on 19 April 2011 by the Statute Law Revision Act 2011 (Commonwealth); and
(b) on 1 July 2011 by the Human Services Legislation Amendment Act 2011 (Commonwealth); and
(c) on 4 August 2011 by the Child Support (Registration and Collection) Amendment Act 2011 (Commonwealth); and
(d) on 27 December 2011 by the Acts Interpretation Amendment Act 2011 (Commonwealth); and
(e) on 30 June 2012 by the Social Security and Other Legislation (2012 Budget and Other Measures) Act 2012 (Commonwealth) Sch. 7.
6. Section 4 amended
(1) In section 4(b) delete “1 October 2010; and” and insert:
1 July 2012; and
Note: This amendment is made to ensure that the adoption by

(e) on 26 May 2012 by the Social Security and Other Legislation (Disability Support Pension Participation Reforms) Act 2012 (Commonwealth) Sch. 4 Pt. 1 Div. 1; and
(f) on 30 June 2012 by the Social Security and Other Legislation (2012 Budget and Other Measures) Act 2012 (Commonwealth) Sch. 7; and
(g) on 1 July 2012 by the Social Security and Other Legislation (2012 Budget and Other Measures) Act 2012 (Commonwealth) Sch. 5.
(2) In section 4(b) delete “1 July 2012; and” and insert:
1 January 2013; and
Note: This amendment is made to ensure that the adoption by Western Australia of the Child Support (Assessment) Act 1989 (Commonwealth) will, from 1 January 2013, extend to that Act as amended on that date by the Social Security and Other Legislation (Disability Support Pension Participation Reforms) Act 2012 (Commonwealth) Sch. 4 Pt. 1 Div. 2.
(3) In section 4(b) delete “1 January 2013; and” and insert:
1 July 2013; and
Note: This amendment is made to ensure that the adoption by Western Australia of the Child Support (Assessment) Act 1989 (Commonwealth) will, from 1 July 2013, extend to that Act as amended on that date by the Social Security and Other Legislation (Disability Support Pension Participation Reforms) Act 2012 (Commonwealth) Sch. 4 Pt. 1 Div. 3.
