W.A. Marine (Construction, Stability and Engineering) Regulations 1983

1.Citation

These regulations may be cited as the W.A. Marine (Construction, Stability and Engineering) Regulations 1983 1.

2.Commencement

These regulations shall come into operation on 1 July 1983.

3.Interpretation

(1)In these regulations, unless the contrary intention appears — 

Authority means the chief executive officer;

Code means the Uniform Shipping Laws Code adopted by the Marine and Ports Council of Australia and published in the Commonwealth of Australia Gazette on 11 May 1981.

(2)In the construction of the Code as incorporated in these regulations, words and expressions defined in Section 1 of the Code shall, unless otherwise provided by the Act or these regulations, have the meanings assigned in that Section.

4.Classification of vessels

For the purposes of these regulations, vessels shall be classified in the manner provided by clause 6 of Section 1 of the Code.

5.Application of Sections 5 and 6 of Code

The provisions of Sections 5 and 6 of the Code are incorporated in these regulations and shall extend and apply to and in respect of all vessels and voyages to which the Act applies.

6.Application of Section 8 of Code

(1)Subject to subregulation (2), the provisions of Section 8 of the Code are incorporated in these regulations and shall extend and apply to and in respect of all vessels and voyages to which the Act applies.

(2)The incorporation and application of Section 8 of the Code by subregulation (1) is subject to the following modifications — 

(a)in clause C.3, for “Class 2D and 2E Vessels” there shall be substituted the following — 

Class 2D and 2E Vessels 16 Metres and Over in Measured Length ”;

(b) in clause C.3.2, for “all vessels 16 metres in measured length and over but less than 20 metres in measured length” there shall be substituted the following — 

“all vessels of Classes 2A, 2B and 2C 20 metres in measured length and over but less than 24 metres in load line length and vessels of Classes 2D and 2E 16 metres and over in measured length ”.

7.Application of Section 9 of Code

The provisions of Section 9 of the Code are incorporated in these regulations and shall extend and apply to and in respect of all vessels and voyages to which the Act applies.
