First Home Owner Grant Amendment Act 2000

An Act to amend the First Home Owner Grant Act 2000.

The Parliament of Western Australia enacts as follows:

 

1.           Short title

             This Act may be cited as the First Home Owner Grant Amendment Act 2000.

2.           Commencement

     (1)    Except as stated in subsection (2), this Act comes into operation on the day on which it receives the Royal Assent.

     (2)    Section 8 is to be taken to have come into operation on 1 July 2000.

3.           The Act amended

             The amendments in this Act are to the First Home Owner Grant Act 2000*.

4.           Section 7 amended

             Section 7(1) is amended as follows:

                 (a)    after “grant if” by inserting —

            , on the commencement date of the eligible transaction to which the application relates,

”;

                 (b)    by deleting paragraph (b) and inserting the following paragraph instead —

    (b)    on the commencement date of the eligible transaction to which the application relates, the person has lived on that basis with the applicant for at least 2 years.

”.

5.           Section 11 amended

             Section 11(1)(a) is amended by deleting “an earlier” and inserting instead —

             “ another ”.

6.           Section 12 amended

             Section 12(3) is amended by deleting “date on which the application is made,” and inserting instead —

            commencement date of the eligible transaction to which the application relates,

”.

7.           Amendments relating to “Australian citizen”

     (1)    Section 3(1) is amended by deleting the definition of “Australian citizen” and inserting the following definition instead —

    Australian citizen has the meaning given by section 7A;

”.

     (2)    After section 7 the following section is inserted in Part 1 —

7A.        Meaning of “Australian citizen”

            A person is an Australian citizen for the purposes of an application for a first home owner grant if, on the commencement date of the eligible transaction to which the application relates, the person is an Australian citizen under the Australian Citizenship Act 1948 of the Commonwealth.

8.           Amendments relating to “permanent resident”

     (1)    Section 3(1) is amended by deleting the definition of “permanent resident” and inserting the following definition instead —

    permanent resident has the meaning given by section 7B;

”.

 

     (2)    Before section 8 the following section is inserted in Part 1 —

7B.        Meaning of “permanent resident”

            A person is a permanent resident for the purposes of an application for a first home owner grant if, on the commencement date of the eligible transaction to which the application relates —

    (a)    the person is —

     (i)    the holder of a permanent visa within the meaning of section 30 of the Migration Act 1958 of the Commonwealth; or

     (ii)    a New Zealand citizen who is the holder of a special category visa within the meaning of section 32 of the Migration Act 1958 of the Commonwealth;

             and

    (b)    the person has satisfied the Commissioner that he or she intends to reside permanently in Australia.
