Parliamentary Legislation Amendment Act 2006

An Act to amend the —

·Constitution Acts Amendment Act 1899; and

·Salaries and Allowances Act 1975.

The Parliament of Western Australia enacts as follows:

Part 1  Preliminary

1.           Short title

             This is the Parliamentary Legislation Amendment Act 2006.

2.           Commencement

             This Act comes into operation on the day after the day on which it receives the Royal Assent.

Part 2  Constitution Acts Amendment Act 1899 amended

3.           The Act amended in this Part

             The amendments in this Part are to the Constitution Acts Amendment Act 1899*.

4.           Section 44A amended

     (1)    Section 44A(4) is amended by deleting “If the Premier so approves”.

     (2)    Section 44A(4) is amended by inserting after “allowance” —

             “ or allowances ”.

     (3)    Section 44A(5) is repealed and the following subsection is inserted instead —

    (5)    The allowances referred to in subsection (4) are —

    (a)    an allowance in respect of holding the office of Parliamentary Secretary; and

    (b)    an allowance for and in respect of expenses necessarily or reasonably incurred in connection with the office of Parliamentary Secretary,

            determined under the Salaries and Allowances Act 1975 section 6.

Part 3  Salaries and Allowances Act 1975 amended

5.           The Act amended in this Part

             The amendments in this Part are to the Salaries and Allowances Act 1975*.

6.           Section 4 amended

             Section 4(2)(k) is amended by deleting “of a party in the Legislative Assembly of at least 5 members” and inserting instead —

             in the Parliament of a party of at least 5 members of Parliament

”.

7.           Section 6 amended

             Section 6(1)(b) is amended by deleting “members of committees of a House or joint committees of both Houses;” and inserting instead —

             a member, other than an officer, of Parliament who is the Chairman, Deputy Chairman or a member of a standing committee of a House or a joint standing committee of both Houses;
