Electricity Industry Amendment Act 2007

An Act to amend the Electricity Industry Act 2004.
[Assented to 21 December 2007]
The Parliament of Western Australia enacts as follows:
1. Short title
This is the Electricity Industry Amendment Act 2007.
2. Commencement
This Act comes into operation as follows:
(a) sections 1 and 2 — on the day on which this Act receives the Royal Assent;
(b) the rest of the Act — on the day after that day.
3. The Act amended
The amendment in this Act is to the Electricity Industry Act 2004.
4. Section 134 inserted
After section 133 the following section is inserted —
“
134. Regulations as to excluding Corporations legislation
(1) In this section —
“market rules” has the meaning given in Part 9;
“matter” includes act, omission, body, person or thing.
(2) The regulations may declare a matter dealt with, provided for, done or occurring under this Act, the regulations or the market rules to be an excluded matter for the purposes of the Corporations Act 2001 (Commonwealth) section 5F in relation to —
(a) the whole of the Corporations legislation to which the Corporations Act 2001 (Commonwealth) Part 1.1A applies; or
(b) a specified provision of that legislation; or
(c) that legislation other than a specified provision; or
(d) that legislation otherwise than to a specified extent.
”.
