Environment Regulations Amendment (Firearms) Regulations 2024

Made by the Governor in Executive Council.

Part 1 — Preliminary

1.Citation

These regulations are the Environment Regulations Amendment (Firearms) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

(a)Part 1 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on the day on which the Firearms Act 2024 section 440 comes into operation.

Part 2 — Biodiversity Conservation Regulations 2018 amended

3.Regulations amended

This Part amends the Biodiversity Conservation Regulations 2018.

4.Regulation 3 amended

In regulation 3 in the definitions of category A firearm and category B firearm delete “Firearms Regulations 1974 regulation 6A(1);” and insert:

regulations referred to in the Firearms Act 2024 section 8(1);

Part 3 — Botanic Gardens and Parks Regulations 1999 amended

5.Regulations amended

This Part amends the Botanic Gardens and Parks Regulations 1999.

6.Regulation 32 amended

In regulation 32(4) delete the definition of firearm and insert:

firearm has the meaning given in the Firearms Act 2024 section 6.

Part 4 — Conservation and Land Management Regulations 2002 amended

7.Regulations amended

This Part amends the Conservation and Land Management Regulations 2002.

8.Regulation 2 amended

(1)In regulation 2 in the definition of ammunition delete “Firearms Act 1973 section 4;” and insert:

Firearms Act 2024 section 5;

(2)In regulation 2 in the definition of firearm delete “Firearms Act 1973 section 4;” and insert:

Firearms Act 2024 section 6;

(3)In regulation 2 in the definition of major firearm part delete “Firearms Act 1973 section 4;” and insert:

Firearms Act 2024 section 14(1);

9.Regulation 121 amended

In regulation 121(1) in the definitions of category A firearm and category B firearm delete “Firearms Regulations 1974 regulation 6A(1);” and insert:

regulations referred to in the Firearms Act 2024 section 8(1);

Part 5 — Environmental Protection (Noise) Regulations 1997 amended

10.Regulations amended

This Part amends the Environmental Protection (Noise) Regulations 1997.

11.Regulation 16B amended

In regulation 16B delete the definition of shooting venue and insert:

shooting venue means premises that are a licensed firearm range as defined in the Firearms Act 2024 section 5.

Part 6 — Zoological Parks Authority Regulations 2002 amended

12.Regulations amended

This Part amends the Zoological Parks Authority Regulations 2002.

13.Regulation 25 amended

In regulation 25(1) delete the definition of firearm and insert:

firearm has the meaning given in the Firearms Act 2024 section 6.
