Petroleum Retailers Rights and Liabilities Repeal Act 2025

No. 16 of 2025

An Act —

·to repeal the Petroleum Retailers Rights and Liabilities Act 1982 and regulations made under that Act; and

·to make consequential amendments to the Petroleum Products Pricing Act 1983.

[Assented to 31 October 2025]

The Parliament of Western Australia enacts as follows:

Part 1 — Preliminary

1.Short title

This is the Petroleum Retailers Rights and Liabilities Repeal Act 2025.

2.Commencement

This Act comes into operation as follows —

(a)Part 1 — on the day on which this Act receives the Royal Assent;

(b)the rest of the Act — on the day after that day.

Part 2 — Petroleum Retailers Rights and Liabilities Act 1982 and regulations repealed

3.Written laws repealed

(1)The Petroleum Retailers Rights and Liabilities Act 1982 is repealed.

(2)The Petroleum Retailers Rights and Liabilities Regulations 1982 are repealed.

Part 3 — Petroleum Products Pricing Act 1983 amended

4.Act amended

This Part amends the Petroleum Products Pricing Act 1983.

5.Section 3 amended

(1)In section 3(1) delete the definition of dispensing equipment.

(2)In section 3(1) insert in alphabetical order:

 

bulk storage means a storage tank or a number of storage tanks for motor fuel installed at a site;

dispensing equipment means —

(a)in relation to petrol or diesel fuel — a pump that transfers fuel from any bulk storage into the part of a motor vehicle designed to hold that kind of fuel for use in the propulsion of that vehicle; or

(b)in relation to LPG fuel — a device that transfers LPG fuel from any bulk storage into the part of a motor vehicle designed to hold LPG fuel for use in the propulsion of that vehicle;

 

6.Section 7 amended

(1)In section 7(1):

(a)in paragraph (a) delete “and the Petroleum Retailers Rights and Liabilities Act 1982,”;

(b)in paragraph (b) delete “and the Petroleum Retailers Rights and Liabilities Act 1982”.

(2)In section 7(4) delete “Act and the Petroleum Retailers Rights and Liabilities Act 1982,” and insert:

7.Section 22E amended

(1)At the end of section 22E(1) insert:

 

Penalty for this subsection: a fine of $20 000.

 

(2)At the end of section 22E(2) insert:

 

Penalty for this subsection: a fine of $20 000.

 

(3)At the end of section 22E(4) insert:

 

Penalty for this subsection: a fine of $20 000.

 

(4)At the end of section 22E delete the Penalty.

8.Section 22F amended

(1)At the end of section 22F(1) insert:

 

Penalty for this subsection: a fine of $20 000.

 

(2)At the end of section 22F(2) insert:

 

Penalty for this subsection: a fine of $20 000.

 

(3)At the end of section 22F(3) insert:

 

Penalty for this subsection: a fine of $20 000.

 

(4)At the end of section 22F delete the Penalty.

9.Various references to “Petroleum Retailers Rights and Liabilities Act 1982” deleted

In the provisions listed in the Table:

(a)delete “and the Petroleum Retailers Rights and Liabilities Act 1982”;

(b)delete “or the Petroleum Retailers Rights and Liabilities Act 1982” (each occurrence).
