Working with Children (Screening) Amendment Regulations 2025

Made by the Governor in Executive Council.

1.Citation

These regulations are the Working with Children (Screening) Amendment Regulations 2025.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Working with Children (Screening) Regulations 2005.

4.Regulation 3D amended

(1)In regulation 3D(1) insert in alphabetical order:

 

amendment day means 19 December 2023, being the day on which the Teacher Registration Amendment Act 2023 (other than sections 1 and 2 of that Act) came into operation;

former TR Act means the TR Act as in force immediately before amendment day;

 

(2)After regulation 3D(1) insert:

 

(1A)For the purposes of paragraph (b) of the definition of conduct review finding or outcome in section 4, each of the following is a conduct review finding or outcome —

(a)the suspension by a disciplinary committee of the registration of a teacher under the TR Act section 70(1)(b)(i);

(b)the suspension by the Teacher Registration Board of the registration of a teacher under the TR Act section 80(2)(b);

(c)the disqualification by SAT under the TR Act section 84(1)(b) of a person from having registration granted;

(d)the suspension by SAT of the registration of a teacher under the TR Act section 84(1)(c)(i) or (3)(c);

(e)the cancellation by SAT of the registration of a teacher under the TR Act section 84(1)(c)(iv) or (3)(f).

 

(3)In regulation 3D(2):

(a)delete “The following are prescribed for the purposes of the definition of conduct review finding or outcome in section 4 —” and insert:

 

For the purposes of paragraph (b) of the definition of conduct review finding or outcome in section 4, each of the following that occurred before amendment day is a conduct review finding or outcome —

 

(b)before “TR Act” (each occurrence) insert:

5.Regulation 6 amended

In regulation 6(3) delete “3D(2).” and insert:

 

3D(1A) or (2).
