Commerce Regulations Amendment (Electricity) Regulations 2026

Made by the Governor in Executive Council.

Part 1 — Preliminary

1.Citation

These regulations are the Commerce Regulations Amendment (Electricity) Regulations 2026.

2.Commencement

These regulations come into operation as follows —

(a)Part 1 — on the day on which these regulations are published on the WA legislation website (publication day);

(b)Part 2 (but only Division 3) — on 1 July 2026;

(c)the rest of the regulations — on the day after publication day.

Part 2 — Electricity (Licensing) Regulations 1991 amended

Division 1 — Preliminary

3.Regulations amended

This Part amends the Electricity (Licensing) Regulations 1991.

Division 2 — Amendments commencing on day after publication day

4.Regulation 3 amended

In regulation 3(1) insert in alphabetical order:

 

eNotice portal means the electronic communication management system maintained by the department for generating, delivering and storing notices under the Act;

 

5.Regulation 19 amended

In regulation 19(2)(g) delete “under ground”.

6.Regulation 50AB replaced

Delete regulation 50AB and insert:

 

50AB.Employer to be satisfied former apprentice has successfully completed apprenticeship

(1)In this regulation —

former apprentice means a person —

(a)who holds an electrician’s training licence; and

(b)who purports to have successfully completed an apprenticeship for electricians approved by the Board.

(2)A person (the employer) must not employ a former apprentice to carry out electrical work unless the employer has taken all reasonable steps to be satisfied that the former apprentice —

(a)has successfully completed the apprenticeship that the former apprentice purports to have completed; and

(b)has applied for their electrical worker’s licence to be endorsed as an electrician’s licence.

 

7.Regulation 51 amended

In regulation 51(1) delete “operator” and insert:

 

operator, in accordance with regulation 52A(2),

9.Regulation 52A amended

(1)Delete regulation 52A(2) and insert:

 

(2)A preliminary notice or notice of completion must be delivered to the relevant network operator —

(a)by means of the eNotice portal; or

(b)if the person delivering the notice has been approved by the Director under subregulation (2A) to deliver the notice in another manner — in that manner; or

(c)if the eNotice portal is unavailable at the time of delivery — in another manner approved by the Director under subregulation (2B) for the purposes of this paragraph.

(2A)The Director may approve a person, or persons in a class of person, to deliver a preliminary notice or notice of completion in a manner other than by means of the eNotice portal if the Director is satisfied that it would be unreasonable to require the person, or persons in that class, to use the eNotice portal.

(2B)For the purposes of subregulation (2)(c), the Director must approve another manner in which a person may deliver a preliminary notice or notice of completion to the relevant network operator if the eNotice portal is unavailable for use.

 

(2)In regulation 52A(3) delete “notice is delivered under subregulation (2)(a) or (b)” and insert:

 

preliminary notice or notice of completion is delivered to the relevant network operator by means of the eNotice portal under subregulation (2)(a) or by another means of electronic communication approved by the Director under subregulation (2)(b) or (c)

10.Regulation 52B amended

(1)Delete regulation 52B(1) and insert:

 

(1)Subject to subregulations (3) and (5) and regulations 52BA and 52BB, an electrical contractor who carries out any electrical installing work, or causes any electrical installing work to be carried out, commits an offence unless, within the period of 28 days after the completion of the electrical installing work, an electrical safety certificate in respect of the electrical installing work, in a form approved by the Director —

(a)is prepared in accordance with subregulation (4D); and

(b)is completed in accordance with subregulation (4); and

(c)is delivered to the person for whom the work was carried out.

 

(2)After regulation 52B(4C) insert:

 

(4D)For the purposes of subregulation (1)(a), an electrical safety certificate must be prepared by the relevant electrical contractor or, if subregulation (5) applies, by the licensed electrical worker —

(a)by means of the eNotice portal; or

(b)if the person preparing the certificate has been approved by the Director under subregulation (4E) to prepare the certificate in another manner — in that manner; or

(c)if the eNotice portal is unavailable at the time of completion — in another manner approved by the Director under subregulation (4F) for the purposes of this paragraph.

(4E)The Director may approve a person, or persons in a class of person, to prepare an electrical safety certificate in a manner other than by means of the eNotice portal if the Director is satisfied that it would be unreasonable to require the person, or persons in that class, to use the eNotice portal.

(4F)For the purposes of subregulation (4D)(c), the Director must approve another manner in which a person may prepare an electrical safety certificate if the eNotice portal is unavailable for use.

 

(3)In regulation 52B(4):

(a)delete “An electrical safety certificate is not duly” and insert:

 

For the purposes of subregulation (1)(b), an electrical safety certificate is not

 

(b)delete paragraph (a).

(4)After regulation 52B(5) insert:

 

(5A)An electrical safety certificate prepared under subregulation (4D) by electronic means is to be regarded as having been signed or executed for the purposes of subregulation (4)(f) if —

(a)in the case of a certificate prepared by an electrical contractor — the name of the contractor appears in the appropriate place in the certificate; or

(b)in the case of a certificate prepared by a licensed electrical worker — the name of the worker appears in the appropriate place in the certificate.

11.Regulations 63C and 63D inserted

After regulation 63B insert:

 

63C.Disclosure of licensing information to network operator

(1)In this regulation —

licensing information means information or material disclosed to or obtained by the Board under these regulations.

(2)The Board may disclose licensing information to a relevant network operator for a purpose related to the performance of the relevant network operator’s functions under the Act.

63D.Access to information in eNotice portal

The Director and any officer of the department may access, inspect and make use of information contained in the eNotice portal for a purpose related to the administration or enforcement of the Act.

 

Division 3 — Amendments commencing on 1 July 2026

12.Regulation 3 amended

(1)In regulation 3(1) delete the definition of executive officer.

(2)In regulation 3(1) insert in alphabetical order:

 

approved form means a form approved by the Board;

register means the register kept under regulation 56(1);

 

13.Regulation 14 amended

(1)In regulation 14(1) delete “a person to be executive officer to the Board and may designate or appoint other”.

(2)In regulation 14(3) delete “The executive officer and any person designated or appointed under subregulation (1) shall,” and insert:

14.Regulation 22 replaced

Delete regulation 22 and insert:

 

22.Eligibility for electrical worker’s licences and permits

(1)An electrical worker’s licence endorsed as an electrician’s licence must not be issued to a person unless —

(a)the person has successfully completed an apprenticeship for electricians approved by the Board; or

(b)the person has had training and experience that are, in the opinion of the Board, at least equal to that which is required to satisfy paragraph (a).

(2)An electrical worker’s licence endorsed as an electrician’s training licence must not be issued to a person unless the Board is satisfied that the person has —

(a)been assessed as satisfactory in relation to safety in the manner approved by the Board; and

(b)entered into —

(i)an apprenticeship for electricians approved by the Board; or

(ii)a course of training for electricians approved by the Board.

(3)An electrical worker’s licence endorsed as a restricted licence must not be issued to a person unless the Board is satisfied that —

(a)the electrical work of the kind and in the circumstances to be authorised by the licence is associated with the activity in which the person is or intends to be engaged; and

(b)the person has had such training or experience or both as the Board may require having regard to the electrical work authorised by the licence to be carried out.

(4)A permit to carry out electrical work must not be issued to a person unless the Board is satisfied that the person has had such training or experience or both as the Board may require having regard to the electrical work authorised by the permit to be carried out.

15.Regulation 23 amended

Delete regulation 23(1) and insert:

 

(1)An application for the issue of a licence or permit must be —

(a)made to the Board in the approved form; and

(b)accompanied by —

(i)unless subparagraph (ii) applies — the application fee in Schedule 1 item 1(a) and the registration fee in Schedule 1 item 1(b); or

(ii)if the application is for an electrician’s training licence — the application fee in Schedule 1 item 1(a).

 

16.Regulation 24 amended

Delete regulation 24(4) and (5).

17.Regulation 25 inserted

After regulation 24 insert:

 

25.Registration of licences or permits

If the Board issues a licence or permit, it must register the licence or permit by entering into the register —

(a)the name of the licence or permit holder; and

(b)any other particulars the Board considers relevant.

 

18.Regulation 26 amended

(1)In regulation 26(1) delete “regulations, or until the name of the holder of the licence is removed from the register under these”.

(2)Delete regulation 26(1A) and (2) and insert:

 

(2)The registration of an electrician’s training licence has effect, subject to any suspension of the licence under these regulations, on and from the day on which the licence is issued until whichever of the following occurs first —

(a)the holder of the electrician’s training licence is issued with an electrician’s licence;

(b)a period of 3 months elapses from immediately after the completion by the holder of the electrician’s training licence of an apprenticeship which satisfies the requirement set out in regulation 22(1)(a);

(c)if the holder of the electrician’s training licence is undertaking a course of training for the purpose of satisfying the requirement set out in regulation 22(2)(b)(ii) —

(i)a period of 3 months elapses from immediately after the completion by the licence holder of the course of training; and

(ii)the licence holder has not entered into an apprenticeship for electricians approved by the Board under regulation 22(2)(b)(i);

(d)the registration of the electrician’s training licence expires under subregulation (2C);

(e)the electrician’s training licence is cancelled by the Board under these regulations.

(2A)If the holder of an electrician’s training licence is undertaking an apprenticeship for the purpose of satisfying the requirement set out in regulation 22(2)(b)(i) and the relevant training contract (as defined in regulation 19(1A)) is —

(a)suspended — the electrician’s training licence is, by operation of this paragraph, suspended during the period of suspension of the relevant training contract; or

(b)cancelled or terminated — the electrician’s training licence is, by operation of this paragraph, suspended until the licence holder enters into another relevant training contract.

(2B)If the holder of an electrician’s training licence is undertaking a course of training for the purpose of satisfying the requirement set out in regulation 22(2)(b)(ii) and, before the completion of the course of training, the holder of the electrician’s training licence —

(a)defers the course of training — the electrician’s training licence is, by operation of this paragraph, suspended until the licence holder recommences the course of training; or

(b)is, for any reason, no longer undertaking the course of training — the electrician’s training licence is, by operation of this paragraph, suspended until the licence holder commences another course of training.

(2C)The registration of an electrician’s training licence expires —

(a)unless paragraph (b), (c) or (d) applies — on the day (the original expiry day) specified in the licence, which cannot be more than 6 years after the day on which the licence is issued; or

(b)if an application is made under regulation 26A(2) and, either before or after the original expiry day, the Board determines to extend the registration of the licence — on the day specified in the notice given by the Board under that subregulation; or

(c)if an application is made under regulation 26A(2) and after the original expiry day the Board determines not to extend the registration of the licence — on the day on which the Board notifies the licence holder of the Board’s decision to refuse to extend the registration of the licence; or

(d)if an application is made under regulation 26A(2) and after the original expiry day, but before the Board determines the application, the licence holder withdraws the application — on the day on which the application is withdrawn.

 

19.Regulation 27 replaced

Delete regulation 27 and insert:

 

26A.Extension of registration of electrician’s training licence

(1)In this regulation —

original expiry day has the meaning given in regulation 26(2C)(a).

(2)On an application made to the Board by the holder of an electrician’s training licence before the original expiry day, the Board may, by notice in writing to the holder of the licence, extend the registration of the licence to a day specified in the notice.

(3)An application made under subregulation (2) must be made to the Board in the approved form.

(4)The Board cannot extend the registration of an electrician’s training licence by more than a period of 2 years after the original expiry day.

(5)If an application is made under subregulation (2) but the Board does not determine the application before the original expiry day, the registration of the electrician’s training licence continues to have effect on and from the original expiry day until it expires in accordance with regulation 26(2C)(b), (c) or (d).

27.Renewal of registration of licences

(1)Subject to regulation 29, the Board must renew the registration of a licence (other than an electrician’s training licence) issued under regulation 24(1) or restored under regulation 27B(1) on an application made not earlier than 90 days before, and not later than 30 days after, the date of the expiry of the registration if the licence has not been cancelled under these regulations.

(2)An application under subregulation (1) for the renewal of the registration of a licence must be —

(a)made to the Board in the approved form; and

(b)accompanied by the renewal of registration fee in Schedule 1 item 2.

27A.Effect of renewal on period of registration of licences

(1)If an application is made under regulation 27(1) for the renewal of the registration of a licence and the registration is renewed before the expiry of the registration, the renewal has effect on and from the day immediately following the day on which the registration would, but for the renewal, have expired.

(2)If an application is made under regulation 27(1) for the renewal of the registration of a licence before the expiry of the registration, but the application is not determined before the expiry of the registration —

(a)the registration of the licence continues to have effect on and from the day immediately following its expiry until whichever of the following occurs first —

(i)the Board notifies the licence holder that it refuses to accept the application;

(ii)the licence holder withdraws the application;

(iii)the Board notifies the licence holder that it has renewed, or has refused to renew, the registration of the licence;

and

(b)the registration of the licence, if renewed, is taken to have been renewed on the day immediately following its expiry.

(3)If an application is made under regulation 27(1) for the renewal of the registration of a licence after the expiry of the registration, and the registration is renewed —

(a)the renewal has effect only for the balance of the period mentioned in the licence that remains after the registration is renewed; and

(b)the renewal of the registration does not affect the illegality of anything done after the registration expired and before it was renewed.

Example for this subregulation:

For the purposes of paragraph (a), if an application to renew the registration of a licence that expires on 1 July is made after 1 July but on or before 30 July, and the registration is renewed, the registration has effect until 1 July the following year.

(4)Nothing in this regulation affects any power under these regulations to cancel a licence.

27B.Restoration of registration of licence

(1)The Board must restore the registration of a licence (other than an electrician’s training licence) issued under regulation 24(1) on an application made more than 30 days after the registration of the licence has expired if the Board is satisfied that the applicant fulfils the requirements set out in regulations 22 and 24(1).

(2)An application under subregulation (1) for the restoration of the registration of a licence must be —

(a)made to the Board in the approved form; and

(b)accompanied by the application fee in Schedule 1 item 3(a) and the restoration of registration fee in Schedule 1 item 3(b).

(3)If an application is made under subregulation (1) for the restoration of the registration of a licence and the registration is restored —

(a)the registration has effect on and from the day on which it is restored until the expiry day specified in the licence; and

(b)the restoration of the registration does not affect the illegality of anything done after the registration expired and before it was restored.

(4)Nothing in this regulation affects any power under these regulations to cancel a licence.

27C.Board required to give licence or permit document

(1)If the Board issues, renews or restores a licence or permit (with or without restrictions or conditions), the Board must give the licence or permit holder a licence or permit document in a form approved by the Director.

(2)The licence or permit document must specify the period of registration of the licence or permit, as the case requires.

27D.Board required to give reasons for decision to refuse or to impose restrictions or conditions

(1)This regulation applies if the Board —

(a)refuses to issue, renew or restore a licence or permit; or

(b)issues, renews or restores a licence or permit subject to restrictions or conditions.

(2)The Board must give the applicant or the licence or permit holder, as the case requires, written reasons for the decision.

 

20.Regulation 29 replaced

Delete regulation 29 and insert:

 

29.Board may require physical examinations and competency tests

(1)In this regulation and regulation 29A —

competency test means —

(a)a theoretical assessment; or

(b)a practical assessment; or

(c)an examination; or

(d)a trade test.

(2)The Board may, by written notice, require a person who has applied under regulation 23 for a licence or permit to undergo either or both of the following within a specified period or before a specified time —

(a)an examination of the person’s physical fitness by a person acceptable to the Board;

(b)a competency test as specified by the Board.

(3)The Board may, by written notice, require a person who holds a licence or permit to undergo either or both of the following, if applicable, within a specified period or before a specified time —

(a)an examination of the person’s physical fitness by a person acceptable to the Board;

(b)if the Board is not satisfied as to the ability of the person to carry out electrical work in a safe and satisfactory manner — a competency test as specified by the Board.

(4)Not less than 12 months before the expiry of the registration of a licence, the Board may, by written notice given to the licence holder, require the licence holder to undergo a specified course of training relating to electrical safety within a specified period or before a specified time.

29A.Results of physical examinations and competency tests

(1)Subregulation (2) applies if a person given written notice under regulation 29 to undergo an examination of the person’s physical fitness, a competency test or course of training —

(a)fails to undergo the examination, competency test or course of training within the period or before the time specified in the notice, as the case requires; or

(b)fails to produce to the Board evidence considered by the Board to be satisfactory concerning the results of that examination, competency test or course of training; or

(c)fails in that examination, competency test or course of training to meet the standards considered by the Board to be appropriate.

(2)The Board may refuse to grant a licence or permit to the person, or if the person is the holder of a licence or permit, the Board may —

(a)refuse to renew the registration of the licence; or

(b)make an order suspending or cancelling the licence or permit.

(3)An order made by the Board under subregulation (2)(b) must be in writing and a copy of the order given to the person against whom it is made.

(4)A person given written notice under regulation 29 to undergo an examination of the person’s physical fitness, a competency test or course of training must pay the examination, competency test or course of training fees —

(a)if the examination, competency test or course of training is conducted by the Board — as determined by the Director; or

(b)if the examination, competency test or course of training is conducted by a body approved by the Board or the Director to do so — as determined by the body.

 

21.Regulation 36 amended

At the end of regulation 36 insert:

23.Regulation 38 amended

Delete regulation 38(2a) and insert:

 

(2A)The holder of a licence may, by giving notice in writing to the Board together with the fee in Schedule 1 item 4(a) or (b), as the case requires, nominate a person —

(a)as a replacement for a nominee; or

(b)as an additional nominee.

 

24.Regulation 39 amended

(1)Delete regulation 39(1) and insert:

 

(1)An application for the issue of a licence must be —

(a)made to the Board in the approved form; and

(b)accompanied by —

(i)for an electrical contractor’s licence — the application fee in Schedule 1 item 5(a) and the registration fee in Schedule 1 item 5(b); or

(ii)for an in‑house electrical installing work licence — the application fee in Schedule 1 item 6(a) and the registration fee in Schedule 1 item 6(b).

 

(2)In regulation 39(2) delete “or renewal of registration”.

(3)Delete regulation 39(3).

25.Regulation 40 amended

(1)In regulation 40(1):

27.Regulation 44 replaced

Delete regulation 44 and insert:

 

44.Renewal of registration of licences issued under r. 40

(1)Subject to regulation 45A(4), the Board must renew the registration of a licence issued under regulation 40(1) or restored under regulation 44AB(1) on an application made not earlier than 90 days before, and not later than 30 days after, the date of the expiry of the registration if the licence has not been cancelled under these regulations.

(2)An application under subregulation (1) for the renewal of the registration of an electrical contractor’s licence must be —

(a)made to the Board in the approved form and must include details, as specified in the approved form, of the prescribed policy of insurance; and

(b)accompanied by the renewal of registration fee in Schedule 1 item 7.

(3)An application under subregulation (1) for the renewal of the registration of an in‑house electrical installing work licence must be —

(a)made to the Board in the approved form; and

(b)accompanied by the renewal of registration fee in Schedule 1 item 8.

(4)If the Board renews the registration of a licence under subregulation (1), the period of registration cannot be a period ending more than 3 years after the registration of the licence would, but for the renewal, have expired.

44AA.Effect of renewal on period of registration of licences

(1)If an application is made under regulation 44(1) for the renewal of the registration of a licence and the registration is renewed before the expiry of the registration, the renewal has effect on and from the day immediately following the day on which the registration would, but for the renewal, have expired.

(2)If an application is made under regulation 44(1) for the renewal of the registration of a licence before the expiry of the registration, but the application is not determined before the expiry of the registration —

(a)the registration of the licence continues to have effect on and from the day immediately following its expiry until whichever of the following occurs first —

(i)the Board notifies the licence holder that it refuses to accept the application;

(ii)the licence holder withdraws the application;

(iii)the Board notifies the licence holder that it has renewed, or has refused to renew, the registration of the licence;

and

(b)the registration of the licence, if renewed, is taken to have been renewed on the day immediately following its expiry.

(3)If an application is made under regulation 44(1) for the renewal of the registration of a licence after the expiry of the registration, and the registration is renewed —

(a)the renewal has effect only for the balance of the period mentioned in the certificate of registration that remains after the registration is renewed; and

(b)the renewal of the registration does not affect the illegality of anything done after the registration expired and before it was renewed.

Example for this subregulation:

For the purposes of paragraph (a), if an application to renew the registration of a licence that expires on 1 July is made after 1 July but on or before 30 July, and the registration is renewed, the registration has effect until 1 July the following year.

(4)Nothing in this regulation affects any power under these regulations to cancel a licence.

44AB.Restoration of registration of licence

(1)The Board must restore the registration of a licence issued under regulation 40(1) on an application made more than 30 days after the registration of the licence has expired if the Board is satisfied that the applicant fulfils the requirements set out in regulation 36 or 37, as the case requires, and regulation 40(1).

(2)An application under subregulation (1) for the restoration of the registration of an electrical contractor’s licence must be —

(a)made to the Board in the approved form; and

(b)accompanied by the application fee in Schedule 1 item 9(a) and the restoration of registration fee in Schedule 1 item 9(b).

(3)An application under subregulation (1) for the restoration of the registration of an in‑house electrical installing work licence must be —

(a)made to the Board in the approved form; and

(b)accompanied by the application fee in Schedule 1 item 10(a) and the restoration of registration fee in Schedule 1 item 10(b).

(4)If an application is made under subregulation (1) for the restoration of the registration of a licence and the registration is restored —

(a)the registration has effect on and from the day on which it is restored until the expiry day specified in the licence; and

(b)the restoration of the registration does not affect the illegality of anything done after the registration expired and before it was restored.

(5)Nothing in this regulation affects any power under these regulations to cancel a licence.

44AC.Board required to give licence document and certificate of registration

(1)If the Board issues a licence (with or without restrictions or conditions), the Board must give to the licence holder, in a form approved by the Director —

(a)a licence document; and

(b)a certificate of registration.

(2)If the Board renews or restores the registration of a licence (with or without restrictions or conditions), the Board must give to the licence holder, in a form approved by the Director, a certificate of registration.

(3)A certificate of registration must specify the period of registration of the licence.

44AD.Board required to give reasons for decision to refuse or to impose restrictions or conditions

(1)This regulation applies if the Board —

(a)refuses to issue, renew or restore a licence; or

(b)issues, renews or restores a licence subject to restrictions or conditions.

(2)The Board must give the applicant or licence holder, as the case requires, written reasons for the decision.

 

28.Regulation 45A amended

(1)In regulation 45A(1) insert in alphabetical order —

 

specified person means any of the following —

(a)an individual who holds an electrical contractor’s licence in accordance with regulation 36(1) or who has applied to be issued with an electrical contractor’s licence;

(b)a person who is a member of a firm that holds an electrical contractor’s licence in accordance with regulation 36(2) or that has applied to be issued with an electrical contractor’s licence;

(c)a person who holds an in‑house electrical installing work licence or who has applied to be issued with an in‑house electrical installing work licence;

(d)a person who is nominated for the purposes of regulation 36 or 37.

 

(2)In regulation 45A(1) in the definition of relevant licence delete “requires.” and insert:

(3)Delete regulation 45A(2) and (3) and insert:

 

(2)The Board may, by written notice, require a specified person to undergo either or both of the following within a specified period or before a specified time —

(a)an examination of their physical fitness by a person acceptable to the Board;

(b)any other examination required under this Part.

(3)Subregulation (4) applies if a person given written notice under subregulation (2) to undergo an examination of the person’s physical fitness or other examination —

(a)fails to undergo the examination within the period or before the time specified in the notice, as the case requires; or

(b)fails to produce to the Board evidence considered by the Board to be satisfactory concerning the results of that examination; or

(c)fails in that examination to meet the standards considered by the Board to be appropriate.

 

(4)After regulation 45A(5) insert:

 

(6)A person given written notice under subregulation (2) to undergo an examination of the person’s physical fitness or other examination must pay the examination fees —

(a)if the examination is conducted by the Board — as determined by the Director; or

(b)if the examination is conducted by a body approved by the Board or the Director to do so — as determined by the body.

29.Regulation 53A amended

30.Regulation 56 replaced

Delete regulation 56 and insert:

 

56.Register of licence and permit holders

(1)The Board must keep a register that contains the following —

(a)the name of all persons who are holders of a licence or permit under these regulations;

(b)any other particulars required by these regulations;

(c)any other information as determined by the Board.

(2)The Board may amend, add to or correct the register in any manner that the Board considers necessary to make the register an accurate record of the information it records.

(3)The Board may publish the register on a website maintained by, or on behalf of, the State.

(4)If a person makes an application to the Board, the Board must give the person —

(a)an extract from the register; or

(b)a copy of the register.

(5)Any private contact details, including residential addresses, personal telephone numbers and personal email addresses, may be redacted from —

(a)the register published under subregulation (3); and

(b)any extract from the register or a copy of the register given to a person under subregulation (4).

 

31.Regulation 60 replaced

Delete regulation 60 and insert:

 

60.Replacement of licence or permit document or certificate of registration

(1)In this regulation —

original document means —

(a)a licence or permit document given under regulation 27C(1) or 44AC(1)(a); or

(b)a certificate of registration given under regulation 44AC(1)(b).

(2)If the Board is satisfied that an original document has been lost, destroyed, defaced or mutilated it may, on application in writing to the Board and payment of the fee in Schedule 1 item 12(a), (b) or (c), as the case requires, issue to the holder a replacement (replacement document) for the original document.

(3)If the original document has been defaced or mutilated, the Board may refuse to issue a replacement document until the defaced or mutilated original document is returned to the Board.

(4)A replacement document is taken to be the original document for the purposes of these regulations.

 

32.Regulation 61 amended

In regulation 61(a) and (b) delete “29(3),” and insert:

64.Fees payable

The fees set out in Schedule 1, other than the further inspection fee in Schedule 1 item 11, are payable to the Director in respect of the matters referred to in Schedule 1 column 1.

Note for this regulation:

The further inspection fee in Schedule 1 item 11 is payable to the relevant network operator. See regulation 53A(1).

64A.Refund of certain fees

(1)This regulation applies if —

(a)the Board refuses, or a person withdraws, an application made by a person under —

(i)regulation 23(1) or 39(1) for the issue of a licence or permit; or

(ii)regulation 27(1) or 44(1) for the renewal of the registration of a licence; or

(iii)regulation 27B(1) or 44AB(1) for the restoration of the registration of a licence;

and

(b)the person has paid the registration fee, the renewal of registration fee or the restoration of registration fee, as the case requires, in respect of the application.

(2)The Director must refund the registration fee, the renewal of registration fee or the restoration of registration fee, as the case requires, to the person.

 

34.Regulation 68 inserted

At the end of Part 6 insert:

 

68.Transitional provisions for Commerce Regulations Amendment (Electricity) Regulations 2026

(1)In this regulation —

commencement day means the day on which the Commerce Regulations Amendment (Electricity) Regulations 2026 regulation 30 comes into operation;

former register means any register of licence holders established under these regulations and in existence immediately before commencement day.

(2)A former register continues on and from commencement day as part of the register kept by the Board under regulation 56(1).

(3)The amendments to Parts 3 and 4 made by the Commerce Regulations Amendment (Electricity) Regulations 2026 Part 2 Division 3 do not apply to applications made to the Board under Parts 3 or 4, but not determined, before 1 July 2026.
