Security and Related Activities (Control) Amendment Regulations 2026

Made by the Governor in Executive Council.

1.Citation

These regulations are the Security and Related Activities (Control) Amendment Regulations 2026.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on 1 June 2026.

3.Regulations amended

These regulations amend the Security and Related Activities (Control) Regulations 1997.

4.Regulation 3 amended

Delete regulation 3(2).

5.Regulation 17 replaced

Delete regulation 17 and insert:

 

17.Prescribed examinations (Act s. 47(1)(f)(ii) and 52(1)(g)(ii))

(1)The following examinations are prescribed for the purposes of sections 47(1)(f)(ii) and 52(1)(g)(ii) —

(a)for a Class 3 security consultant’s licence and a Class 3 security installer’s licence — a written examination on the installation of security doors of the kind prescribed by regulation 7;

(b)for a crowd control agent’s licence — a written examination on the obligations of a crowd control agent under the Act;

(c)for a crowd controller’s licence — a written examination on crowd control activities;

(d)for an inquiry agent’s licence — a written examination on the obligations of an inquiry agent under the Act;

(e)for a security agent’s licence — a written examination on the obligations of a security agent under the Act;

(f)for a security officer’s licence — a written examination on watching, guarding and protecting property.

(2)An examination referred to in subregulation (1)(a) must be approved by the Superintendent under regulation 17A.

(3)An examination referred to in subregulation (1)(b), (c), (d), (e) or (f) must —

(a)test the applicant’s knowledge of the relevant subject matter; and

(b)be set by the Superintendent or by a course provider approved under regulation 16(3).

17A.Approval of examination for Class 3 security consultant’s licence and Class 3 security installer’s licence

(1)In this regulation —

Australian Standard means a standard published —

(a)by Standards Australia; or

(b)jointly by Standards Australia and Standards New Zealand.

(2)The Superintendent may, in writing, approve an examination for the purposes of regulation 17(1)(a) if the Superintendent —

(a)has identified, and is satisfied that the examination tests the applicant’s knowledge of, an Australian Standard relating to the installation of security doors of the kind prescribed by regulation 7; and

(b)is satisfied that the examination has been set by a person who is a fit and proper person to set the examination.

(3)The Superintendent may approve an examination subject to any conditions and restrictions the Superintendent thinks fit.

(4)As soon as practicable after approving an examination, the Superintendent must —

(a)inform the person who set the examination of the approval; and

(b)publish on a website maintained by, or on behalf of, the Department —

(i)notification of the approval; and

(ii)the title of the Australian Standard the Superintendent identified, and in relation to which the Superintendent was satisfied, under subregulation (2)(a).

 

6.Part 9 inserted

After regulation 59 insert:

 

Part 9 — Transitional provision for Security and Related Activities (Control) Amendment Regulations 2026

60.Examination continues to be prescribed for Class 3 security consultant’s licence and Class 3 security installer’s licence

(1)This regulation applies if, in the period beginning on 1 June 2025 and ending on 31 May 2026, a person passed an examination that was prescribed by regulation 17(1).

(2)The examination continues to be prescribed for the purposes of section 47(1)(f)(ii), but only —

(a)in relation to an application made by the person for a Class 3 security consultant’s licence or a Class 3 security installer’s licence; and

(b)until the day that is 1 year after the day on which the person passed the examination.

(3)The examination continues to be prescribed for the purposes of section 52(1)(g)(ii), but only in relation to an application made by the person for a Class 3 security consultant’s licence or a Class 3 security installer’s licence.
