District Court (Fees) Amendment Regulations 2026
Made by the Governor in Executive Council.
These regulations come into operation as follows —
(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;
(b)the rest of the regulations — on the day after that day.
These regulations amend the District Court (Fees) Regulations 2002.
After regulation 6(3) insert:
(3A)An application under subregulation (3) must be made at or before the time the fee becomes payable.
Note: The heading to amended regulation 6 is to read:
Fees to be paid before documents filed or other things done
After regulation 8(1) insert:
(1A)Except with the leave of the Court or a registrar, an application cannot be made later than 28 days after the day on which the fee for the item or the matter in respect of which the applicant is seeking to pay the eligible individual fee or eligible entity fee (as is relevant) —
(a)becomes payable; or
(b)is paid.
(1B)The Court or a registrar may give leave under subregulation (1A) only if satisfied that exceptional circumstances justify the leave being given.
