Fish Resources Management Act 1994
Fish Resources Management Amendment Regulations (No. 4) 2026
Made by the Governor in Executive Council.
These regulations come into operation as follows —
(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website (publication day);
(b)regulations 3 to 5 — on the day after publication day;
(c)the rest of the regulations — on 1 June 2026.
These regulations amend the Fish Resources Management Regulations 1995.
In regulation 14(1) in the Table delete items 2 and 3.
(1)In regulation 45(1) delete the definition of closed season.
(2)In regulation 45(2) delete “During the closed season a” and insert:

(3)Delete regulation 45(3) and insert:
(3)Subregulation (2) does not apply to a person in relation to a demersal scalefish, if —
(a)the fish is taken by a person for a commercial purpose in accordance with an authorisation; or
(b)the fish is taken during a fishing tour on a charter boat outside the Metropolitan Area (as described in the West Coast Demersal Scalefish (Interim) Management Plan 2007 Schedule 2).
(4)After regulation 45(4) insert:
(5)Subregulation (2)(c) does not apply to a person in relation to a demersal scalefish, if —
(a)the fish is not a West Australian dhufish; and
(b)the fish was taken using a pointed instrument; and
(c)the person who took the fish —
(i)did not use a boat when taking the fish; and
(ii)entered and exited the water from the shore when taking the fish.
Note: The heading to amended regulation 45 is to read:
Recreational fishing for demersal scalefish in West Coast Region prohibited subject to exceptions
After regulation 65A(2) insert:
(3)Despite subregulation (2), no grouped bag limit applies to Redfish, Bight (Red Snapper, Nannygai), Redfish, Yelloweye and Swallowtail in the South Coast region.
After regulation 65CA insert:
65CB.Bag limits for sharks and rays
For the purposes of section 50 of the Act, the bag limit for all species of sharks and rays is the quantity specified in Schedule 3 Division 2 Subdivision 3.
(1)In Schedule 2 Part 2 Division 3 Subdivision 2 delete the items for:
Emperor, all species except Grass Emperor and Spangled Emperor
Redfish, Yelloweye
Swallowtail
Tuskfish, Blue
(2)In Schedule 2 Part 2 Division 3 Subdivision 2 insert in alphabetical order:
