Liquor Control Act 1988

Liquor Control Regulations Amendment Regulations 2026

Made by the Governor in Executive Council.

Part 1  Preliminary

1.Citation

These regulations are the Liquor Control Regulations Amendment Regulations 2026.

2.Commencement

These regulations come into operation as follows —

(a)Part 1 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on 1 July 2026.

Part 2  Liquor Control Regulations 1989 amended

3.Regulations amended

This Part amends the Liquor Control Regulations 1989.

4.Regulation 3 amended

Delete regulation 3(1) and (2).

Note: The heading to amended regulation 3 is to read:

5.Regulation 3A amended

(1)In regulation 3A(1) delete the definition of notional wholesale selling price.

(2)In regulation 3A(1) insert in alphabetical order:

 

low alcohol liquor means liquor in which the concentration of ethanol does not exceed 3.5% at 20°C;

 

6.Regulation 4 deleted

Delete regulation 4.

7.Regulation 8A amended

(1)In regulation 8A(1) in the definition of negative determination paragraph (f) delete “protection order,” and insert:

 

business continuity order,

 

(2)In regulation 8A(4)(e):

(a)in subparagraph (ii) delete “protection order” and insert:

(1)In this regulation —

long‑term extended hours permit has the meaning given in Schedule 3 clause 2(2) of the Act.

(2)For the purposes of section 38(1)(b), a long‑term extended hours permit is prescribed.

 

11.Regulation 10C amended

(1)In regulation 10C(3)(a) delete “evidence” and insert:

 

evidence, of a kind referred to in section 126(1)(b)(i),

 

(2)Delete regulation 10C(4).

12.Regulation 11 amended

Delete regulation 11(1d).

Note: The heading to amended regulation 11 is to read:

13.Regulation 13 amended

Delete regulation 13(1) and insert:

 

(1)For the purposes of section 65D(4)(b), the records to accompany an application for the grant, or approval of the transfer, of a licence, other than an occasional licence, must —

(a)be in the form of a written statement; and

(b)contain, in respect of each applicant, the details set out in the 3rd column of Schedule 2 opposite the relevant category of applicant described in the 2nd column of that Schedule.

14.Regulations 14AB and 14AC replaced

Delete regulations 14AB and 14AC and insert:

 

14AB.Time for making an application for occasional licence or prescribed extended trading permit (Act s. 67(1))

(1)In this regulation —

prescribed permit means an extended trading permit to be issued —

(a)for the purposes referred to in section 60(4)(a), (cb), (f), (g) or (h); and

(b)for a specified period not exceeding 3 weeks.

(2)For the purposes of section 67(1), an application for an occasional licence or a prescribed permit must be made —

(a)if the anticipated number of patrons is greater than 500 but not greater than 5 000 — not later than 60 days before the licence or permit is to take effect; or

(b)if the anticipated number of patrons is greater than 5 000 — not later than 90 days before the licence or permit is to take effect.

 

15.Regulation 14ADA amended

Delete regulation 14ADA(2)(a) and insert:

 

(a)made in the approved form; and

16.Regulation 14ADD amended

Delete regulation 14ADD(2)(a) and insert:

32.Regulation 25 amended

(1)In regulation 25(1) delete “moneys payable under the Act be paid” and insert:
