Building Amendment Regulations 2026
Made by the Governor in Executive Council.
These regulations come into operation as follows —
(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;
(b)the rest of the regulations — on the day after that day.
These regulations amend the Building Regulations 2012.
After regulation 71 insert:

72.Building permit not required for certain building work commenced before commencement
A building permit is not required for building work for which a building permit was not required under Schedule 4 clause 2 items 9 and 9A as in force immediately before the day on which the Building Amendment Regulations 2026 regulation 3 comes into operation if —
(a)the building work had commenced before that day; or
(b)a contract to carry out the building work was entered into before that day.
In Schedule 4 clause 2 in the Table delete items 9 and 9A and insert:

Building work for — (a)a structure that — (i)is fitted or designed for human habitation; and (ii)is located at a caravan park (as defined in the Caravan Parks and Camping Grounds Act 1995 section 5(1)) in relation to which a licence is granted under that Act; and (iii)was a vehicle in respect of which a vehicle licence was not required under the Road Traffic (Vehicles) Act 2012 section 4, because, due to its size, it could not be drawn by another vehicle on a road (as defined in the Road Traffic (Administration) Act 2008 section 4); or (b)an attachment to a structure referred to in paragraph (a) that — (i)is used as an extension of the habitable area of that structure; and (ii)has walls and a roof and can be assembled or dismantled within 24 hours by no more than 2 people. |

Building work for — (a)a structure that — (i)is not a vehicle, train, vessel or aircraft; and (ii)is moveable or capable of movement; and (iii)is fitted or designed for habitation; and (iv)is located at a caravan park (as defined in the Caravan Parks and Camping Grounds Act 1995 section 5(1)) in relation to which a licence is granted under that Act; and (v)immediately prior to 1 July 2019 was located at a place with an approval purportedly given under the Caravan Parks and Camping Grounds Regulations 1997 regulation 30(1) for the structure to be brought onto the place; or (b)an attachment to a structure referred to in paragraph (a) that — (i)is used as an extension of the habitable area of that structure; and (ii)has walls and a roof and can be assembled or dismantled within 24 hours by no more than 2 people. |
