Industrial Relations Act 1979
Industrial Relations (Industrial Agents) Amendment Regulations 2026
Made by the Governor in Executive Council.
These regulations come into operation as follows —
(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;
(b)the rest of the regulations — immediately after the Industrial Relations (Industrial Agents) Regulations 2026 regulation 3 comes into operation.
These regulations amend the Industrial Relations (Industrial Agents) Regulations 2026.
(1)In regulation 26(1) in the definition of Australian Resources and Energy Employer Association:
(a)delete “Resources and” and insert:
Resources &
(b)delete “Association;” and insert:
Association (Incorporated);
(2)Delete regulation 26(4) and insert:
(4)A person who, immediately before commencement day, was an employee of an industrial agent (as defined in regulation 3 of the repealed regulations), and would have been authorised under section 112A(3) of the former Act to perform the functions set out in section 112A(3)(d) and (e) of the former Act, is taken to be a subsidiary industrial agent for the purposes of these regulations.
(3)In regulation 26(5) delete “Resources and” and insert:

(4)Delete regulation 26(6) and insert:
(6)A person who, immediately before commencement day, was an employee or officer of the Australian Resources & Energy Employer Association, and would have been authorised under section 112A(3) of the former Act to perform the functions set out in section 112A(3)(d) and (e) of the former Act, is taken to be a subsidiary industrial agent for the purposes of these regulations.
