Strata Titles Act 1985

Strata Titles (General) Amendment Regulations 2026

Made by the Governor in Executive Council.

1.Citation

These regulations are the Strata Titles (General) Amendment Regulations 2026.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Strata Titles (General) Regulations 2019.

4.Regulation 90 amended

In regulation 90 insert in alphabetical order:

National Register has the meaning given in the National Vocational Education and Training Regulator Act 2011 (Cth) section 3;

5.Regulation 95 amended

In regulation 95 in the Table delete item 1 and insert:

A principal who is a qualified person

Either —

(a)have completed 6 units in a Certificate IV in Strata Community Management; or

(b)hold a Diploma of Property (Agency Management — Strata)

6.Regulations 97D and 97E replaced

Delete regulations 97D and 97E and insert:

97D.Transitional provision for prescribed experience qualifications

(1)For the purposes of section 144(1)(b)(ii), if a person is, before 1 November 2027, required to satisfy an experience requirement under regulation 97B(2), the person is taken to satisfy the requirement —

(a)if the person is the principal of a strata manager — until the beginning of 1 November 2029; or

(b)if the person is employed or engaged by a strata manager as a strata community manager — until the beginning of 1 November 2028.

(2)If subregulation (1) applies to a person, the strata manager is taken to comply with regulation 97C(1) in relation to the person.

97E.Transitional provision for strata management contract prescribed experience requirements

Regulation 97C does not apply to a strata management contract entered into before 1 November 2027.

7.Regulation 102 amended

In regulation 102(2)(b) delete “4” and insert:
