Electricity Industry Amendment (Capital Charges) Act (No. 2) 2026

No. 13 of 2026

An Act to amend the Electricity Industry Act 2004.

[Assented to 19 August 2026]

The Parliament of Western Australia enacts as follows:

 

1.Short title

This is the Electricity Industry Amendment (Capital Charges) Act (No. 2) 2026.

2.Commencement

This Act comes into operation as follows —

(a)sections 1 and 2 — on the day on which this Act receives the Royal Assent;

(b)the rest of the Act — when the Electricity Industry Amendment (Capital Charges) Act 2026 section 4 comes into operation.

3.Act amended

This Act amends the Electricity Industry Act 2004.

4.Section 129ZE inserted

After section 129ZD insert:

 

129ZE.Imposition of tax

To the extent that a capital charge payable under this Part includes an amount that is a tax, the tax is imposed.
