Working with Children (Screening) Amendment Regulations 2026

Made by the Governor in Executive Council.

1.Citation

These regulations are the Working with Children (Screening) Amendment Regulations 2026.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on 17 September 2026.

3.Regulations amended

These regulations amend the Working with Children (Screening) Regulations 2005.

4.Regulation 3 amended

In regulation 3 delete the definition of Australian Crime Commission.

5.Regulation 3E amended

Delete regulation 3E(d) and insert:

 

(d)the Working with Children Check Act 2000 (Qld);

 

6.Regulation 3F amended

In regulation 3F delete “Australian Crime Commission” and insert:

 

ACC

 

Note: The heading to amended regulation 3F is to read:

ACC is criminal records agency (s. 4)

7.Regulation 4 amended

(1)Delete regulation 4(1)(a) and (b) and insert:

 

(a)a negative notice or interim negative notice has been issued to the child and is current; or

(b)the child is the subject of an adverse interstate WWC decision.

 

(2)In regulation 4(2) delete “(3) and (4),” and insert:

 

(3), (4) and (5),

 

(3)Delete regulation 4(3)(a) and (b) and insert:

 

(a)a negative notice or interim negative notice has been issued to the person and is current; or

(b)the person is the subject of an adverse interstate WWC decision.

 

(4)Delete regulation 4(4)(a) and (b) and insert:

 

(a)a negative notice or interim negative notice has been issued to the child and is current; or

(b)the child is the subject of an adverse interstate WWC decision.

 

(5)After regulation 4(4) insert:

 

(5)Subregulation (2) does not apply to the following work carried out by a person who is the subject of an adverse interstate WWC decision —

(a)work described in Schedule 1 clause 12;

(b)work described in Schedule 1 clause 17.

 

8.Regulation 7 amended

Delete regulation 7(a)(iii) and insert:

 

(iii)the Education and Care Services National Law Application Act 2026;

 

9.Regulation 7B amended

In regulation 7B delete “Australian Crime Commission” and insert:

 

ACC

 

Note: The heading to amended regulation 7B is to read:

Police information may be disclosed to ACC (s. 34I(3))

Note: The heading to regulation 7A is to read:

Information that may be disclosed to ACC (s. 34G(2))
