Building Act 2011

Building Amendment Regulations (No. 3) 2026

Made by the Governor in Executive Council.

1.Citation

These regulations are the Building Amendment Regulations (No. 3) 2026.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on 1 November 2026.

3.Regulations amended

These regulations amend the Building Regulations 2012.

4.Regulation 41 amended

(1)In regulation 41(1)(a) and (b) delete “Class 10 building” and insert:

 

Class 10a or 10b building

 

(2)After regulation 41(2) insert:

 

(2A)A building permit is not required for building work for a Class 10c building or incidental structure that is located, or to be located, in the Murchison local government district.

 

5.Regulation 43 amended

In regulation 43(b) delete “41(1)(a) or (b);” and insert:

 

41(1)(b);

 

6.Part 12 inserted

After Part 11 insert:

 

Part 12 — Transitional provision for Building Amendment Regulations (No. 3) 2026

73.Building permit not required for Class 10c buildings or incidental structures commenced before start day

(1)In this regulation —

start day means the day on which the Building Amendment Regulations (No. 3) 2026 regulation 6 comes into operation.

(2)For the purposes of section 9(b), a building permit is not required for building work for a Class 10c building or incidental structure if —

(a)a building permit was not required for the building work under regulation 41(1) as in force immediately before start day; and

(b)either —

(i)the building work commenced before start day; or

(ii)a contract to carry out the building work was entered into before start day.

 

7.Schedule 4 amended

(1)In Schedule 4 clause 1 in the Table delete “Class 10 building” (each occurrence) and insert:

 

Class 10a or 10b building

 

(2)In Schedule 4 clause 1 in the Table after the item for Trayning insert:

 

Upper Gascoyne

Whole district other than townsites
