Criminal Organisations Control Amendment Regulations 2026

Made by the Governor in Executive Council.

1.Citation

These regulations are the Criminal Organisations Control Amendment Regulations 2026.

2.Commencement

These regulations come into operation as follows —

(a)regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

(b)the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Criminal Organisations Control Regulations 2013.

4.Regulation 7 amended

Delete regulation 7(a) to (j) and insert:

(a)the Crimes (Criminal Organisations Control) Act 2012 (NSW) section 7 (declaration);

(b)the Crimes (Criminal Organisations Control) Act 2012 (NSW) section 19 (control order);

(c)the Crimes (Serious Crime Prevention Orders) Act 2016 (NSW) section 5 (control order);

(d)the Serious Crime Control Act 2009 (NT) section 15 (declaration);

(e)the Serious Crime Control Act 2009 (NT) sections 25(2)(a) and 26(4)(a) (control order);

(f)the Penalties and Sentences Act 1992 (Qld) sections 161V to 161Y (control order);

(g)the Serious and Organised Crime (Control) Act 2008 (SA) section 11 (declaration);

(h)the Serious and Organised Crime (Control) Act 2008 (SA) section 22 (control order);

(i)the Criminal Organisations Control Act 2012 (Vic) sections 16 and 27 (control order).

5.Schedule 1 amended

In Schedule 1 Form 1 delete:

othe Crimes (Criminal Organisations Control) Act 2012 (New South Wales) section 19

othe Serious and Organised Crime (Control) Act 2008 (South Australia) section 22

othe Criminal Organisation Act 2009 (Queensland) section 18

othe Criminal Organisations Control Act 2012 (Victoria) section 43

othe Serious Crime Control Act (Northern Territory) section 25(2)(a) or 26(4)(a)

and insert:

othe Crimes (Criminal Organisations Control) Act 2012 (NSW) section 19

othe Crimes (Serious Crime Prevention Orders) Act 2016 (NSW) section 5

othe Serious Crime Control Act 2009 (NT) section 25(2)(a) or 26(4)(a)

othe Penalties and Sentences Act 1992 (Qld) section 161V, 161W, 161X or 161Y

othe Serious and Organised Crime (Control) Act 2008 (SA) section 22

othe Criminal Organisations Control Act 2012 (Vic) section 16 or 27
